TO:                     Mayor Richard C. Irvin

FROM:                     Jennifer Stallings, City Clerk

DATE:                     December 2, 2024

SUBJECT:

A Resolution establishing the maximum number of City of Aurora Liquor Licenses by Class.

PURPOSE:

To increase the number of Class B:  On-Site Consumption liquor licenses.

BACKGROUND:

This request is presented in accordance with the 2011 amendment to the City's Liquor Ordinance, specifically Section 6-9(a), which charges the City Council with the authority to determine the number of licenses available in each classification.

DISCUSSION:

Reynoso Enterprises Corp., d/b/a Taqueria Los Cuates at 470 Hinman St. has submitted a liquor license application to offer alcohol for sale for on-site consumption in their full-service restaurant.  If approved, this liquor license will allow the sale of alcohol during business hours.  Taqueria Los Cuates offers a full menu.

Attached is the application submitted for your consideration.  If approved, this resolution will increase the number of allowable liquor licenses as indicated in the accompanying Exhibit A to allow for the issuance of the license by the Liquor Commissioner.  City staff has been working with the business owner to ensure that all requirements for a liquor license, as set forth in Chapter 6 of the City's Code of Ordinances, are met.  Specifically, given that 470 Hinman St. is within 500 feet of residential property, the applicants also submitted an application to reduce the distance requirement between a liquor licensed establishment and residential property below 500 feet.  As required by the Code of Ordinances Sec. 6-13 (d)(3), notice was made to the Aldermen's Office on October 29, 2024, and November 14, 2024, regarding the application and time and location of the administrative hearing.  After a hearing, on November 21, 2024, the Local Liquor Control Hearing Officer granted the petitioner's request for a distance reduction in this matter.

IMPACT STATEMENT:

The proposed resolution presents an opportunity to further the City of Aurora's economic development and to bring additional business and people to the City of Aurora.

RECOMMENDATIONS:

Staff recommends that this resolution be approved.
