SUBJECT:
An Ordinance Granting a Parking Setback Variance to the north property line, from 23 feet to 5 feet, with a Final Plan for a medical use for property located at 2285 Sequoia Drive, in Kane County, Aurora Illinois  60506  (Advocate Dreyer Medical Clinic - L14-01056 / AU07/2-13.519-Fsd/Fpn/V - AM - Ward 5)   
 
PURPOSE:
The Petitioner, Advocate HealthCare, is proposing a new medical clinic and a detention basin on Lots 1 and 2 of proposed Advocate Dreyer Subdivision, Unit 1 on Sequoia Drive. Advocate HealthCare is proposing to construct a new 2-story Dreyer Medical Clinic requiring a setback variance to accommodate parking lot requirements.   
 
BACKGROUND:
The property is currently zoned Office Research and Light Industrial (ORI).
The property is located north of Sullivan Road, south of the East-West Tollway, east of Orchard Road and west of Randall Road.
Advocate HealthCare offices occupy the lot immediately to the west of this site and it is surrounded west, south and east by properties currently zoned ORI.  
 
DISCUSSION:
Staff has reviewed the variance petition, submitted by the petitioner and have sent comments back to them on those submittals. The petitioner has made all the requested changes to these documents and they now meet all of the applicable codes and ordinances. Said variance is actually adjacent to an inner lot line within the development (the detention lot) and therefore will not impact any exterior buffering for the development.  
 
POLICIES AND GUIDELINES :
12.0 To plan and provide for the growth of the City through the integration of land use patterns and functions that promote complementary interactions between different land use components.
41.1.3 To encourage the location of industrial, office and office-research development near transportation facilities designed to provide adequate and efficient linkages to sources of labor, production materials and markets.
41.1.5 To plan and promote the extension of the office and office-research corridor along the Tollway in the City of Aurora.   
   
 
 
 
RECOMMENDATIONS:
Zoning Board of Appeals recommends APPROVAL of the Setback Variance with a Final Plan for a medical use located at 2285 Sequoia Drive.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
 
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
 
WHEREAS, Advocate HealthCare is the owner of record of the real estate commonly known as 2285 Sequoia Drive and legally described on Exhibit "A-1", attached hereto and incorporated herein by reference as if fully set forth, has made application for a variation of Ordinance No. 3100, being the Aurora Zoning Ordinance, requesting approval of a Parking Setback Variance with a Final Plan for the property at 2285 Sequoia Drive as provided by Section 8.10-5.12.B Setback Requirements of said Ordinance; and
 
WHEREAS, on January 21, 2015, the Zoning Board of Appeals of the City of Aurora held a public hearing and therein found that the requested variation met the standards prescribed by Section 10.5-3 of said Ordinance and therein and recommended APPROVAL; and
 
WHEREAS, on January 29, 2015, the Planning and Development Committee of the City Council of the City of Aurora reviewed the findings and recommendation of the Zoning Board of Appeals of the City of Aurora and recommended approval; and
 
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Aurora, Illinois, as follows:
 
Section One: That the City Council of the City of Aurora, Illinois finds as fact all of the preamble recitals of this Ordinance.
 
Section Two: That the real property commonly known as 2285 Sequoia Drive and legally described on Exhibit "A-1" is hereby granted the following variation from the standards of Ordinance No. 3100, being the Aurora Zoning Ordinance:
 
Section 8.10-5.12.B.ii. Reducing the interior/rear setback requirements from 23 feet to 5 feet.
      
Section Three: That the plan(s), hereafter referred to as Exhibit "A-2" Final Plan, Exhibit "A-3" Landscape Plan, Exhibit "A-4" Building and Signage Elevations, Exhibit "A-5" Fire Plan, shall be attached hereto and incorporated herein by reference as if fully set forth.
 
Section Four: That this Ordinance shall be in full force and effect, and shall be controlling, upon its passage and approval.  
 
Section Five: That all Ordinances or part of Ordinances in conflict herewith are hereby repealed insofar as any conflict exists.  
 
Section Six: That any section, phrase or paragraph of this Ordinance that is construed to be invalid, void or unconstitutional shall not affect the remaining sections, phrases or paragraphs of this Ordinance which shall remain in full force and effect.
 
Section Seven: That the City Clerk of the City of Aurora is hereby authorized and directed to file with Kane County Recorder's Office a certified copy of this Ordinance, on the property legally described on Exhibit "A-1".
