A resolution authorizing the Director of Purchasing to adopt unit prices submitted by Rochelle Waste Disposal and Waste Management of Illinois for the disposal of excavated spoils that cannot be classified as Clean Construction Demolition Debris (non-CCDD).
PURPOSE:
The purpose for this resolution is to provide a means for the City's Water and Sewer Maintenance Division to dispose of spoils that cannot be disposed of as CCDD material.
BACKGROUND:
35 Ill. Adm. Code 1100 requires testing of soils excavated from sites with a history of activity that may have resulted in soil contamination. The code also requires that spoils excavated from residential sites must be testes for pH. Soils that do not meet the requirements for disposal at a Clean Construction Demolition Debris (CCDD) landfill, must be disposed of at a site permitted to accept such contaminated material.
The City of Aurora's Water and Sewer Maintenance Division regularly generates excavated spoils while maintaining the City's water and sewer infrastructure. Environmental Science professional services are required to classify excavated spoils for proper disposal. Depending on the results of the soil analysis, spoils are disposed of as Clean Construction Demolition Debris, non-special waste, or special waste. Disposal costs vary depending on the classification of the spoils.
On August 17th 2016, the City's Purchasing Division advertised a request for proposals for the disposal of non-CCDD material. On August 31, the purchasing division received three proposals from landfill operators. The proposals were evaluated based on per ton dumping costs, trucking expenses, and costs to comply with landfill specific testing requirements. If the spoils are generated near a site with historic industrial use, testing requirements for all three landfills are essentially the same. However, in the event that the spoils are excavated from a residential site, and the pH is outside of the 6.25-9.0 CCDD range, the testing requirements vary amongst the proposers.
For non-CCDD spoils excavated from locations near potentially contaminated properties, Waste Management of Illinois is the most economical disposal facility.
For spoils that are excavated from residential areas that do not meet the CCDD pH requirements, Rochelle Waste Disposal is the most economical disposal facility
DISCUSSION:
Funding for this expense is provided in the 2016 budget within account number 510-4063-511-36-13 Water and Sewer Fund. The per ton dump fee for Waste Management's Laraway and Dekalb facilities is $19.00 and $20.00 respectfully. The per ton dump fee for the Rochelle Waste Disposal facility is $16.00 per ton. Based on past years, the Water and Sewer Division generates approximately 2,500 tons of non-CCDD spoils per year. The unit prices are good for one year.
IMPACT STATEMENT:
This resolution is needed in order to provide a means for disposing of excavated soils that are generated on a day to day basis by the City's Water and Sewer Maintenance Division.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS, on August 31, 2016 the Director of Purchasing received three proposals from landfills for the disposal of excavated spoils that cannot be classified as Clean Construction Demolition Debris, and
WHEREAS, the proposals were evaluated based on proximity, travel time, and testing requirements, and
WHEREAS, the aforementioned evaluation revealed that proposals submitted by Waste Management of Illinois and Rochelle Waste Disposal are advantageous to the City of Aurora depending on the nature of the excavated soil; and
WHEREAS, Waste Management of Illinois submitted per ton dump fees of $19 and $20 for its Laraway and Dekalb facilities respectfully; and Rochelle Waste Disposal submitted a per ton dump fee of $16.00; and
WHEREAS, said per ton fees are valid for 12 months; and
WHEREAS, the City's 2016 budget and proposed 2017 budget include funding for this expense in the Water and Sewer fund within account number 510-4063-511-36-13; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: The Director of Purchasing is hereby authorized to adopt the per ton dump fees submitted by Waste Management of Illinois, and by Rochelle Waste Disposal.
