Resolution Authorizing the Mayor and City Clerk to execute the supplemental agreement for construction engineering services with H.W Lochner for Rte. 59 Metra Commuter Parking Lot Modification and Station Blvd. Extension Project, Section 13-00300-00-PK. Ward 10/Johnson.

 

PURPOSE:

To authorize the Mayor and City Clerk to execute the supplemental agreement for construction engineering services agreement with H.W Lochner.

 

BACKGROUND:

The Route 59 commuter parking lot is located north of Meridian Lake Drive and west of Route 59. The commuter train stop has the highest boarding and ridership numbers of any of the 27 stops on Metra’s BNSF train line. The existing parking lot has capacity for 2,248 parking spaces available for commuters and is typically 100% occupied.  In February 2013, the City applied for federal funding to modify the existing parking lot to address parking demands, reduce congestion and improve safety.  In November of 2013, the City proposed project was approved for federal funding.  The proposed improvements consisted of: reconfiguration and expansion of the existing parking lot (addition of 448 new parking spaces), intersection improvements with new traffic signals, installation of box culverts, relocation of Pace bus staging area, installation of new parking lot lightings (LED) and security cameras, and landscaping. 

 

Construction of the parking lot and extension of Station Blvd began in April 2016 and the project is approximately 80% complete.  Completion is scheduled for end of November 2016 with final landscaping occurring in spring of 2017. Please see attached exhibits for reference. 

 

DISCUSSION:

When the project was originally let in April of 2015, the time frame for construction was 4 months with anticipated time for engineering services of six months.  As the bids came in over the engineer's estimate and the City needed to seek additional federal funding, the project was put on hold.  Modification to the site design and changes to the project specifications and project completion date were done to reduce construction cost.  As a result of these changes, the new construction time frame needed to be changed from six months to seven and a half months this season with additional weeks in spring of 2017.  In January 2016, the project was re-issued for letting by IDOT and awarded for construction in March of 2016. 

 

The overall project schedule was delayed by at least one and half months due to weather delays caused by the wet Spring, which then delayed the installation of the new box culvert at the main entrance.  In addition, there was a utility conflict with AT&T, which caused additional coordination.  Scope of work was added due to field changes, coordination with the City's fiber optic and communication building contractors, relocation of electrical cabinet/controller, sidewalk installation, State budget concerns and the uniqueness of managing a project being constructed in 5 stages while coordinating with more than 2,000 commuters and multiple contractors.  The supplement represents the anticipated cost to complete the inspection of the remaining work and all documentation for project close out per IDOT requirements. 

 

The proposed agreement is a supplement to the original Lochner's construction engineering services agreement to reflect the changes in construction completion. The original agreement with Lochner was executed in April 2015, amended by IDOT in the amount of $244, 061.55.

 

The requested supplement, attached as Exhibit A, is in the amount of $98,059.13.  With this supplement, the new construction engineering service total $342,120.68, representing nearly 6% of the construction cost of $5,560,854. The new total construction engineering service amount is within acceptable limits.

 

The 2016 Budget provides $98,059.13 for this supplement in Account No. 530-4434-437-73.20.

 

 

IMPACT STATEMENT:

The parking lot will be open to traffic at the end of November with completion in the Spring of 2017. Commuters are urged to plan for slightly longer commutes, encourage to use Pace Park-n-Ride facilities, and use caution in construction work area.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, In February of 2013, the City applied for Congestion Mitigation and Air Quality Improvement Program Grant (CMAQ) from CMAP for the proposed improvements at the Routes 59 Commuter Parking Lot.  In November 2013, the City’s received notification from CMAP that the City’s project has been approved for programming; and

 

WHEREAS, the City received design approval on December 30, 2013 from IDOT and entered an Local Agency Agreement with IDOT for construction on April 14, 2015 with amended Local Agency Agreement executed on February 2,2016; and 

 

WHEREAS, the City entered an agreement with H.W. Lochner for construction engineering service on April 14, 2015, Resolution #15-080; and

 

WHEREAS, Due to several factors, the project will be delayed for at least one and half months which will then require additional hours in addition, during the course of the construction scope of work was added; and    

 

WHEREAS, To complete the project, there is a need for a supplement to the construction engineering services with H.W. Lochner, a copy of which construction engineering services agreement is attached hereto and incorporate herein as Exhibit A; and

 

WHEREAS, the 2016 City's Budget provides $98,059.13 for this CIP project # CO63 in account # 530-4434-437-73.20; and

 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: That the Mayor and City Clerk are hereby authorized to execute the supplemental construction engineering services agreement with H.W. Lochner as set forth in Exhibit A for the Route 59 Metra Commuter Parking Lot Modification and Station Blvd. Extension Project. Section 13-00300-00-PK
