A Resolution for Acceptance of Improvements and Maintenance Security for Aurora University - Spartan Athletic Park - Watermain : 17.065
PURPOSE:
To accept the Public Improvements and Maintenance Security for Aurora University - Spartan Athletic Park.
BACKGROUND:
This development has completed all installations, inspections and submissions of the public improvements that make it eligible to be recommended for final acceptance of those improvements. The property where the improvement is installed is within the corporate limits of Montgomery and is not a part of the COA comprehensive plan so it is not subject to annexation. It is further understood that the developer of these improvements will be paying double rates for all water usage.
DISCUSSION:
The Subdivision Control Ordinance, upon the acceptance of the improvements by City Council, requires the posting of a security for a one year maintenance period.
IMPACT STATEMENT:
This action may add new public infrastructure /utilities to various divisions for maintenance, including streets, water, storm, sanitary, electrical, storm water management, fiber optic.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS, Aurora University has completed the public improvements for said project; and
WHEREAS, these said improvements have been inspected during construction by the Engineering Department, or their authorized representative, and were found to be in substantial conformance with the approved plans; and
WHEREAS, the City Engineer has recommended acceptance of the improvements upon posting of a Maintenance Security in the amount of $36,737.00
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: that the acceptance of the improvements be approved upon receipt of a Maintenance Security in the amount of $36,737.00
