SUBJECT:

Ordinance authorizing the sale of the west 50.00 feet City Real Estate (LOT 1), located at 515 Simms Street, Aurora, Illinois, Permanent Index No.: 15-27-380-013.

 

PURPOSE:

Attached is an Ordinance authorizing the sale of the west 50.00 feet of City real estate, Lot 1, commonly known as 515 Simms Street, with PIN 15-27-380-013, to The Frances A. David Declaration of Trust Dated October 13, 2014, who owns the property directly east of the area to be sold (517 Simms Street). Under the terms of the proposed sale, The Frances David Trust will pay the City one dollar ($1.00) and consolidate the land with its current parcel. This sale of includes the entire parcel of said property PIN 15-27-380-013.

 

BACKGROUND:

In July 2016 the City of Aurora was granted a Judicial Deed by the Sixteenth Judicial Circuit, Kane County, Illinois pursuant to the provisions of 65 ILCS 5/11-31-1(d) for property at 515 Simms Street, Aurora, Illinois. The structures on the property are raised. The property is currently exempt from real estate taxes. The lot is to be given to the adjoining land owner (The Frances David Trust) as legally described below:

 

THE WEST 50.00 FEET OF LOT 1 IN BLOCK 2 OF BINDER’S RESUBDIVISION OF PART OF BLOCKS 1, 2 AND 3 OF BINDER’S ADDITION AND PART OF BLOCK 8 OF H. H. EVANS’ THIRD ADDITION TO AURORA, KANE COUNTY, ILLINOIS.

 

DISCUSSION:

The City has made this type of arrangement before with adjacent owners in order to dispose of vacant City-owned lots.

 

IMPACT STATEMENT:

Transfer of the property to the adjoining property owner will move parcel back to the City tax rolls and remove parcel from City maintenance.

 

RECOMMENDATIONS:

 Place on Finance Committee Calendar (6/13/17 Agenda) for approval to City Council.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, the City of Aurora is interested in selling and The Frances A. David Declaration of Trust Dated October 13, 2014 is interested in purchasing real estate known as the West 50.00 Feet of Lot 1 in Block 2 of Binder’s Resubdivision of Part of Blocks 1, 2 and 3 of Binder’s Addition and Part of Block 8 of H. H. Evans’ Third Addition to Aurora, in the City of Aurora, Illinois with PIN Number 15-27-380-013 (“Property”) in accordance with the terms and restrictive covenant set forth in the attached Agreement.

 

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Aurora, Illinois, as follows: that the attached Agreement for the sale of the West 50.00 Feet of Lot 1 in Block 2 of Binder’s Resubdivision of Part of Blocks 1, 2 and 3 of Binder’s Addition and Part of Block 8 of H. H. Evans’ Third Addition to Aurora, in the City of Aurora, Illinois for the sum of $1.00 is hereby approved.  Additionally, Chuck Nelson is hereby authorized to act on the City’s behalf to complete the sale of these properties.
