SUBJECT:

An Ordinance Providing for the Execution of an Easement Agreement between the City of Aurora and Nicor to serve the M14 Hoops property located at west of Church Road and south of Bilter Road (M14 Hoops - 17-00803 / AU02/4-16.011-Fsd/Fpn - AM - Ward 1)

 

PURPOSE:

The Engineering Department is requesting the execution of an Easement Agreement accepting the dedication of a non-exclusive perpetual easement. The requested easement agreement will allow the Developer to install and the City to subsequently reconstruct, operate, maintain, alter, repair, replace or remove an eight (8) inch diameter watermain encased in twenty (20) inch diameter pipe and an eight (8) inch diameter sanitary sewer encased in a twenty (20) inch diameter steel casing across the Nicor Right of Way.

 

BACKGROUND:

The utilities installed in the easement will serve the M14 Hoops property located at west of Church Road and south of Bilter Road which is zoned PDD Planned Development District zoning, and is part of the Farnsworth International Planned Development District. Additional information on the legislative history of that property can be found in the attached Property Information Sheet.

 

DISCUSSION:

Staff has reviewed the Easement Agreement petition and have determined that it meets the applicable codes and ordinances.

 

IMPACT STATEMENT:

Staff would anticipate that this project will increase the City’s overall tax base, by facilitating investment and development, which will offset any incidental Department or staffing impacts.

 

RECOMMENDATIONS:

Staff would recommend APPROVAL of the an Ordinance Providing for the Execution of an Easement Agreement between the City of Aurora and Nicor to serve the M14 Hoops property located at west of Church Road and south of Bilter Road.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, the City desires to enter a non-exclusive Easement Agreement with Nicor permitting the installation and maintenance of water and sanitary sewer utilities across a portion of the Nicor property.

 

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Aurora, Illinois, as follows: that the City Council of the City of Aurora hereby authorizes and directs the Mayor and the City Clerk to enter into the Easement Agreement with Nicor as attached hereto as Exhibit “A” and made part hereof.
