A Resolution for Acceptance of Improvements and Waving the Maintenance Period for 237 Ashland Ave. - Sanitary Sewer Extension - 14.336
PURPOSE:
To accept the Public Improvements and waive the required maintenance period for 237 Ashland Ave. - Sanitary Sewer Extension.
BACKGROUND:
This development has completed all installations, inspections and submissions of the public improvements that make it eligible to be recommended for final acceptance of those improvements.
DISCUSSION:
The Subdivision Control Ordinance, upon the acceptance of the improvements by City Council, requires the posting of a security for a one year maintenance period.
IMPACT STATEMENT:
This action may add new public infrastructure /utilities to various divisions for maintenance, including streets, water, storm, sanitary, electrical, storm water management, fiber optic.
RECOMMENDATIONS:
Due to project specific circumstances, the City Engineer recommends the acceptance of the public improvements and waving of the maintenance period.

A Resolution accepting the improvements and waiving the maintenance period for a Sanitary Sewer Extension at 237 Ashland Ave.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS, Adrian Garcia, the developer of the sanitary sewer extension at 237 Ashland Ave., has completed the public improvements for said project; and
WHEREAS, these said improvements have been inspected during construction by the Engineering Division, or their authorized representative, and were found to be in substantial conformance with the approved plans; and
WHEREAS, the City Engineer has recommended acceptance of the improvements and waiving of the maintenance period,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: that the sanitary sewer extension improvements for 237 Ashland Ave., be accepted and that the maintenance period be waived.
