SUBJECT:

A Resolution Approving the Final Plat for Unit Five of Deerbrook Place Subdivision, Being Vacant Land Located South of Hafenrichter Road and East of Farnsworth Avenue  (Joe Keim Land Corp. - 16-01202 / OS01/2-16.141-FSD - SB - Ward 9)   

 

PURPOSE:

The Petitioner, Joe Keim Land Corp., is requesting approval of a Final Plat for the Resubdivision of Lots 317, 318 and 319 of Deerbrook Place Subdivision located south of Hafenrichter Road and east of Farnsworth Avenue, which includes 8.30 acres of common area open space.

  

 

BACKGROUND:

The Subject Property is located at south of Hafenrichter Road and east of Farnsworth Avenue and is currently Vacant Land/Open Space with R-5(S) Multiple Family Dwelling zoning.  It is located in the Deerbrook, Unit 5 subdivision.  The Deerbrook Place Subdivision included 23 townhome buildings and 4 open space lots.  Eleven of the townhome building have been built on and a portion of the open space lots have been landscaped.   Additional information on the legislative history of the property can be found in the attached Property Information Sheet. 

 

The Petitioner is Requesting approval of a Final Plat for the Resubdivision of Lots 317, 318 and 319 of Deerbrook Place Subdivision.  The details of the request include splitting the portions of the four lots which are adjacent to existing homes and have been developed as landscaped open space from those which have not yet been developed.  The Developer wishes to transfer the developed portions of the open space lots to the Home Owner’s Association and maintain ownership of undeveloped open space lots to be included in the sale of the remaining undeveloped townhome lots to a new homebuilder.   

 

The Petitioner has provided Staff with a copy of a revised Covenants, Conditions, and Restrictions for which reflects the new lot numbers for the open space lots.  These CCRs will be recorded at the time of the recording of the new Final Plat.    

 

DISCUSSION:

Staff has reviewed the Final Plat petition and have sent comments back to the petitioner on those submittals.  The petitioner has made the requested revisions to these documents and they now meet the applicable codes and ordinances.

 

The Petitioner confirmed at the Planning & Development Committee meeting on February 16th, 2017 that they will pay the recording fees for the Final Plat and record the deeds prior to the transfer of ownership to the Homeowner’s Association. 

 

POLICIES AND GUIDELINES :

The Staff’s Evaluation and Recommendation are based on the following Physical Development Policies:

12.1 (8): To promote an accessible open space system that would be based on the various needs generated by the community.

22.5 (5): To recognize the unique characteristics of individual neighborhoods and promote their unique attributes.

81.1 (6): To plan for and promote convenient accessibility to open space to enhance the effective use of open space and recreational facilities in and around the City.  

 

RECOMMENDATIONS:

The Planning Commission recommended APPROVAL of the Resolution Approving the Final Plat for Unit Five of Deerbrook Place Subdivision, Being Vacant Land Located South of Hafenrichter Road and East of Farnsworth Avenue.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, by petition dated December 14, 2016, Joe Keim Land Corp. filed with the City of Aurora a petition Requesting approval of a Final Plat for the Resubdivision of Lots 317, 318 and 319 of Deerbrook Place Subdivision located south of Hafenrichter Road and east of Farnsworth Avenue as attached hereto as Exhibits "A”; and

 

WHEREAS, after referral of said petition from the Aurora City Council, the Aurora Planning Commission, on January 18, 2017, reviewed the petition and recommended APPROVAL of said petition; and

 

WHEREAS, on January 26th, 2017, the Planning and Development Committee of the Aurora City Council reviewed said Final Plat and the before mentioned recommendations and recommended APPROVAL of said petition; and  

 

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Aurora, Illinois, finds as facts all of the preamble recitals of this Resolution and hereby grants APPROVAL of said Final Plat.

 

BE IT FURTHER RESOLVED that the City Council of the City of Aurora hereby adopts the Final Plat and related required documents as attached hereto as Exhibit "A" along with any dedications deemed necessary by the Aurora City Engineer.
