A Building, Zoning and Economic Development Committee Resolution Approving a Final Plat consolidating lot A of Island Avenue Addition and part of lots 8, 9 and 12 of the Assessor's Map of Stolp's Island for the Silver Plate Subdivision located at the northeast corner of Stolp Avenue and East Downer Place (City of Aurora / Olive Tree Properties, LLC - 19-0819 / AU22/3-19.173-FSD - AM - Ward 6)
PURPOSE:
The Petitioner City of Aurora is Requesting approval of a Final Plat consolidating Lot A of Island Avenue Addition and part of Lots 8, 9 and 12 of the Assessor's Map of Stolp's Island for the creation of the Silver Plate Subdivision located at the northeast corner of Stolp Avenue and East Downer Place for a Food and Beverage Services (2500) use. The consolidated lots would then comply with the Subdivision Control Ordinance and allow Olive Tree Properties, LLC to develop part of Lots 8, 9 and 12 of the Assessor's Map.
BACKGROUND:
The Subject Property is currently with DC Downtown Core District zoning.

The consolidation of Lot A of Island Avenue Addition and part of Lots 8, 9 and 12 of the Assessor's Map of Stolp's Island is required by subdivision control ordinance. This will allow the Silver Plate Subdivision to be created, and Olive Tree Properties, LLC to design and plan the construction of a deck above with a patio underneath, for a Food and Beverage Services (2500) use.
DISCUSSION:
Staff has reviewed the Final Plat and have sent comments back to the consultant on these submittals. The consultant has made the requested revisions to the documents and they now meet the applicable codes and ordinances.
IMPACT STATEMENT:
The Planning and Zoning Division would anticipate that this project will increase the City’s overall tax base and viability by facilitating investment and development which will offset any incidental Department or staffing impacts, enhancing the city’s infrastructure and improving services to its residence. Additionally, certain impacts will be offset by the applicable Impact Fees.
RECOMMENDATIONS:
The Planning Commission recommended CONDITIONAL APPROVAL of the Building, Zoning and Economic Development Resolution Approving a Final Plat consolidating lot A of Island Avenue Addition and part of lots 8, 9 and 12 of the Assessor's Map of Stolp's Island for the Silver Plate Subdivision located at the northeast corner of Stolp Avenue and East Downer Place, with the following conditions: Engineering approval of the site improvements is required. Any modifications to the Final Plat that may be necessary to secure Engineering approval shall be made prior to execution of the Final Plat. If a security is required for the proposed improvements, the security shall be posted prior to execution of the Final Plat.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS,by petition dated September 20, 2019, the City of Aurora filed a petition requesting approval of a Final Plat for Silver Plate Subdivision located at the northeast corner of Stolp Avenue and East Downer Place and related required documents as attached hereto as Exhibits "A"; and
WHEREAS, after referral of said petition from the Aurora City Council, the Aurora Planning Commission on October 16, 2019, reviewed the petition and recommended CONDITIONAL APPROVAL of said petition; and
WHEREAS, on October 23, 2019, the Building, Zoning and Economic Development Committee of the Aurora City Council reviewed said Final Plat and the before mentioned recommendations and recommended CONDITIONAL APPROVAL of said petition; and
WHEREAS, the decision of the Building Zoning and Economic Development Committee with respect to a final plat is subject to appeal to the City Council in the manner set forth in the City of Aurora Subdivision Control Ordinance; and
WHEREAS, no person authorized under City of Aurora Subdivision Control Ordinance to appeal such decision having done so in the manner set forth in the Ordinance, the Decision of the Building Zoning and Economic Development Committee constitutes final action on the proposed final plat; and
NOW, THEREFORE, BE IT RESOLVED that the Building, Zoning and Economic Development Committee of the City of Aurora, Illinois, finds as facts all of the preamble recitals of this Resolution and hereby grants CONDITIONAL APPROVAL of said Final Plat with the following condition:
1.) Engineering approval of the site improvements is required. Any modifications to the Final Plat that may be necessary to secure Engineering approval shall be made prior to execution of the Final Plat. If a security is required for the proposed improvements, the security shall be posted prior to execution of the Final Plat.
BE IT FURTHER RESOLVED that the Building, Zoning and Economic Development Committee of the City of Aurora hereby adopts the Final Plat and related required documents as attached hereto as Exhibit "A" Final Plat along with any easement dedications or vacations deemed necessary by the Aurora City Engineer.
