SUBJECT:

Amending the City of Aurora Code of Ordinances, Chapter 17, Article IV, Section 17-135 entitled "Maintenance"

 

PURPOSE:

To amend the City's Fire Alarm Systems Ordinance provision to allow someone other than the Fire Prevention Bureau to receive test documentation.

 

BACKGROUND:

Currently we are accepting fire system test document submittals in various forms such as via email, mail and faxes. We also allow submittal using a third party resource called IROL (Inspection Reports Online).

 

DISCUSSION:

Adding the language "or its designee" will serve to clarify that the Fire Prevention Bureau may use a third party resource as a service provider to receive test documentation. This will serve as a tool to help our office have better data control and enforcement of all testing reports required to be submitted annually.

 

IMPACT STATEMENT:

Benefits to the Fire Prevention Bureau is that this will help us monitor all current fire systems by having one source of fire system test retrieval. By revising the City's ordinance in the manner stated above we will have a proper and concise process for enforcement and compliance of fire systems with deficiencies that require immediate repair to ensure public safety. No additional staffing will be needed and no cost to the City will occur. The third party service provider will collect a fee from the testing company that provides the annual test documentation required annually.

 

RECOMMENDATIONS:

This matter be referred for consideration to the Government Operations Committee on July 28, 2015.

An Ordinance Amending the City of Aurora Code of Ordinances, Chapter 17, Article IV, Section 17-135 entitled "Maintenance"

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, The City deems it necessary and appropriate to amend and clarify this ordinance to allow someone other than the Fire Prevention Bureau to receive reports of fire system testing. :

 

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Aurora, Illinois, as follows: 

 

Section One:                     That Chapter 17, Article IV, Section 17-135 entitled "Maintenance" shall be amended as follows:

 

Sec. 17-135. Maintenance.

 

Each fire alarm user is solely responsible for the installation, maintenance, repair, upkeep and operation of his/her own fire alarm system. All fire alarm systems with the exception of one-family detached dwellings shall be tested and system components cleaned annually by a licensed testing agency or licensed electrical contractor. Documentation of the fire alarm system testing and maintenance shall be submitted to the fire prevention bureau, or its designee, within fourteen (14) days of such testing/cleaning. When a fire alarm system not associated with a one-family detached dwelling is out of service for any reason, the fire chief, a battalion chief, or their designee, may, at their sole discretion, require the fire alarm user to implement a fire watch at the user's expense until such time as the fire alarm system is back in service. If fire department personnel are required to serve on fire watch, the fire alarm user must reimburse the city the actual cost of such personnel and equipment.

Section two:                     That this ordinance shall be in full force and effect, and shall be controlling, upon its passage and approval.

 

Section three:  That all ordinances or parts of ordinances thereof in conflict herewith are hereby repealed to the extent of any such conflict.

 

Section four:  That any section or provision of this ordinance that is construed to be invalid or void shall not affect the remaining sections or provisions which shall remain in full force and effect thereafter.
