A Resolution Accepting the Dedication of an Easement at 2810 Duke Parkway , being Lot 2A Unit 1of Butterfield East Resubdivision of Lot 2 Subdivision located at west of Duke Parkway north of Ferry Road. (Duke Realty Corporation - 16-00489 / WI33/3-15.178-DED/E - AM - Ward 10)
PURPOSE:
The Petitioner, Duke Realty Corporation, is Requesting approval of a Plat of Easement on Lot 2A of Butterfield East Resubdivision of Lot 2 Subdivision, Unit 1.
The details of the proposal include creating the following easements to support the completion of the Butterfield East Unit 3 Infrastructure: 1. A Public Utility easement for the re-routed stormwater system on the north side of the subject site; 2. A Public Utility easement for the proposed sanitary sewer on the north side of the subject site; 3. A temporary utility easement allowing for the construction of the proposed improvements within the first two easements. This easement would expire at the termination of construction; 4. A sidewalk easement at the "pinch point" of Duke Parkway on the east side of the property.
BACKGROUND:
The Subject Property is located at 2810 Duke Parkway and is currently utilized as a Warehouse, Distribution and storage services use (3300) with PDD zoning, which is part of the Butterfield Planned Development District. The property is generally located west of Duke Parkway north of Ferry Road.
DISCUSSION:
Staff has reviewed the Dedication of Easement petition, submitted by the petitioner and have sent comments back to them on those submittals. The petitioner has made all the requested changes to these documents and they now meet all of the applicable codes and ordinances.
IMPACT STATEMENT:
The Planning and Zoning Division would anticipate that this project will increase the City’s overall tax base and viability by facilitating investment and development which will offset any incidental Department or staffing impacts.
RECOMMENDATIONS:
Staff would recommend APPROVAL of the A Resolution Accepting the Dedication of an Easement at 2810 Duke Parkway, being Lot 2A Unit 1of Butterfield East Resubdivision of Lot 2 Subdivision located at west of Duke Parkway north of Ferry Road.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS, it may be necessary in the future to construct and provide utilities in the easement area; and
WHEREAS, upon petition of the property owners, Duke Realty Corporation, the City of Aurora has been offered in dedication suitable vacant land for the purpose of locating utilities and/or providing stormwater detention within an easement(s) as described on Exhibit “A” Plat of Easement attached hereto; and
WHEREAS, the City desires to receive and accept the granting of such real estate, in accordance with Section 11-105-01 of the Illinois Municipal Code (65 ILCS (1994) 5/11-105-1); and
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Aurora, Illinois, as follows: that upon petition of the property owners, the City hereby receives and accepts the granting of the easement(s) as described on Exhibit “A” Plat of Easement attached hereto; provided however, that such acceptance of granting does not relieve the developer of its obligations to construct such utilities in accordance with the City of Aurora Public Improvement Ordinance.
