SUBJECT:
Resolution Authorizing the Execution of an Intergovernmental and Lease Agreement between the City of Aurora, Aurora East School District #131 and the Fox Valley Park District for the tennis facility at Phillips Park, six owned by the City of Aurora and six owned by Aurora East School District #131.
 
PURPOSE:
To obtain City Council approval to enter into this agreement to finance the tennis courts renovation and establish guidelines for the use and maintenance of the courts.
 
BACKGROUND:
All three agencies met last fall and this winter to review the expired agreement and discuss revisions for a new one. The expired intergovernmental agreement was adopted in June of 1992 (R92-250), since then, no major work has been performed on the tennis courts. The courts are in rough shape and beyond their useful life and routine maintenance is not sufficient enough to maintain a safe and playable surface. School District #131 and the Fox Valley Park District have both appropriated $200,000 each in 2015 for the renovation of the tennis courts which is estimated to cost $600,000. The City's maximum contribution for this project is $200,000.
 
DISCUSSION:
To minimize the impact on both the School and the Park District programs the renovations are planned to take place this summer.  Aurora East School District #131 will be the lead agency handling the specifications, bidding and construction management of the tennis court renovation project. The City of Aurora Public Properties Department and Park's Division staff may utilize its labor force for the demolition work to reduce the City's financial contribution. The City carried over funds from 2014 to complete facility improvements.  These improvements will be delayed to allow funding through account 340-4440-451.73-43 for this project.
 
IMPACT STATEMENT:
By not approving this agreement we will be missing an opportunity to secure up to $400,000 from two other entities to renovate the tennis courts that are in need of rehabilitation. Maintenance costs will continue to escalate and persons using the courts could be at risk of injury should the courts continue to deteriorate beyond repair.
 
RECOMMENDATIONS:
That the City Council adopts the Resolution Authorizing the Execution of an Intergovernmental  and Lease Agreement between the City of Aurora, Aurora East School District #131 and the Fox Valley Park District for the tennis facility at Phillips Park, six owned by the City of Aurora and six owned by Aurora East School District #131.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
 
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
 
WHEREAS, the City last entered into an Intergovernmental and Lease Agreement with Aurora East School District #131 and the Fox Valley Park District for the tennis facility at Phillips Park in June of 1992; and
 
WHEREAS, the Intergovernmental and Lease Agreement will commence on April 1, 2015 through and including March 31, 2025 and Aurora East School District #131 agrees to provide specifications, bidding and construction management for the project; and
 
WHEREAS, the City shall pay Aurora East School District #131 a sum totaling 1/3 of the  tennis facility renovation project costs not to exceed $200,000.00 and the City will be allowed to use city labor for demolition work and reduce City's share of the monies needed if it so decides; and
 
WHEREAS, the 2015 Parks Division Budget provides the monies for this item in account 340-4440-451.73-43 (Capital Improvement Fund A).
 
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: Authorizes the execution of the attached Intergovernmental and Lease Agreement with Aurora East School District #131 and the Fox Valley Park District for the tennis facility at Phillips Park, six owned by the City of Aurora and six owned by Aurora East School District #131.
