A Planning and Development Committee Resolution Approving the Final Plat for Lot 1 of the Orchard Road Industrial Subdivision, being Vacant Land, located at the West Side of Deerpath Road and the North Side of I-88 (Panattoni Development Company, Inc. - 18-1045 / SG01/4-18.167-Fsd/Fpn - SB - Ward 5)
PURPOSE:
The Petitioner, Panattoni Development Company, Inc., is requesting approval of a Final Plat for Lot 1 of the Orchard Road Industrial subdivision, which is located on the west side of Deerpath Road and on the north side of I-88, which includes 52.264 acres of vacant land to be developed for office and warehouse use.
BACKGROUND:
The subject property is currently zoned ORI(S), Office, Research, and Light Industrial District with a Special Use Planned Development. It is located in the Bricks, Inc. Special Use Planned Development. The proposed Final Plat and Final Plan are in compliance with the approved Preliminary Plat & Plan Revision which was approved by the Aurora City Council on August 28, 2018 as R18-196. The Petitioner is requesting approval of a Final Plat for Lot 1 of the Orchard Road Industrial subdivision. The details of the request include the platting of a single, 52.264 acre lot, a forty (40) foot right-of-way dedication on the west side of Deerpath Road to accommodate traffic, as well as the granting of necessary City Easements and Stormwater Control Easements throughout the site.
Concurrently with this proposal, the Petitioner is requesting approval of a Final Plan for Lot 1 of the Orchard Road Industrial subdivision. Details of the request include the construction of a multi-tenant, 764,500 sq. ft. building for office and warehouse use. The building will be approximately forty-two (42) feet tall. Vehicles will be able to access the property from Deerpath Road to the east, and Orchard Gateway and Vision Court to the west.
DISCUSSION:
Staff has reviewed the Final Plat petition and have sent comments back to the Petitioner based on those submittals. The Petitioner has made the requested revisions to these documents and they now meet the applicable codes and ordinances, with the exceptions of the conditions identified in the Staff Recommendation below.
POLICIES AND GUIDELINES:
41.1 (1): To attract and encourage industrial, office, and office-research development to
planned sites where requisite public facilities are either present or proposed.
41.1 (3): To encourage the location of industrial, office, and office-research development
near transportation facilities designed to provide adequate and efficient linkages
to sources of labor, production materials, and markets.
41.1 (5): To promote attractive, well-maintained industrial and office-research areas
through landscaping and site design.
RECOMMENDATIONS:
The Planning Commission recommended CONDITIONAL APPROVAL of the Planning and Development Committee resolution approving a Final Plat for Lot 1 of the Orchard Road Industrial Subdivision, being Vacant Land, Located at the West Side of Deerpath Road and the North Side of I-88, with the following conditions:
1) Full-width and full-depth roadway improvements, including street lighting, are to be completed for Deerpath Road, from the north end of the property to no less than one hundred (100) feet south of the curb on the south side of the southerly entrance to the site.
2) Right-of-way for Deerpath Road along the subject property’s frontage, on both sides of Deerpath Road, and in front of the commercial property located at 2124 Deerpath Road, shall be dedicated, and all issues with the Illinois State Toll Highway Authority regarding property and/or easements that may be in conflict with the right-of-way dedication and construction of Deerpath Road shall be resolved prior to occupancy.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS, after referral of said petition from the Aurora City Council, the Aurora Planning Commission on December 12, 2018, reviewed the petition and recommended CONDITIONAL APPROVAL of said petition; and
WHEREAS, on January 10, 2019, the Planning and Development Committee of the Aurora City Council reviewed said Final Plan and Plat and the before mentioned recommendations and recommended CONDITIONAL APPROVAL of said petition; and
NOW THEREFORE, BE IT RESOLVED that the City Council of the City of Aurora, Illinois, finds as facts all of the preamble recitals of this Resolution and hereby grants CONDITIONAL APPROVAL of said Final Plat with the following conditions:
