SUBJECT:

A resolution ratifying the increase of purchase order 291277 with Rochelle Waste Disposal to $27,548.64 for disposal fees associated with special and non-special waste disposal.

 

PURPOSE:

The purpose for this resolution is to obtain authorization to increase purchase order 291277 with Rochelle Waste Disposal from $25,000.00 to $27,548.64 to pay for spoils that have been disposed of by the Water and Sewer Maintenance Division.

 

BACKGROUND:

35 ILL. Adm. Code 1100 requires testing of soils excavated from sites with a history of activity that may have resulted in soil contamination. Soils that do not meet the requirements for disposal at a Clean Construction Demolition Debris landfill must be disposed of at a facility permitted to accept such contaminated material.

 

The City of Aurora's Water and Sewer Maintenance Division regularly generates excavated spoils while maintaining the City's water and sewer infrastructure. Since the majority of Water and Sewer Maintenance's excavations are reactionary, it is impractical to determine the amount of spoils that must be disposed of as special or non-special waste prior to performing the work. Earlier this year the Water and Sewer Maintenance Division repaired more watermain breaks than normal. Also, there was an unusual number of watermain breaks in areas that have soils that must be disposed of as special or non-special waste. Consequently, the purchase order for the disposal expenses was exceeded early in the budget year.

 

A separate resolution is being sent to committee for review/approval for the disposal of excavated soil that was selected by a formal bid process that will be in place for the next year.

 

DISCUSSION:

The 2019 budget provides $80,000 funding for this service in account 510-4063-511.36-13 in the Water and Sewer Fund.

 

IMPACT STATEMENT:

Adoption of this resolution will ensure that payments for services previously rendered will comply with the City of Aurora's Purchasing Policy.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, expenditures for special and non-special waste spoils disposal have exceeded the threshold requiring City Council approval, and

 

WHEREAS, the 2019 budget provides $80,000 funding for the special and non-special waste in account 510-4063-511.36-13; and

 

 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: The Director of Purchasing is hereby authorized to increase purchase order 291277 with Rochelle Waste Disposal by Two Thousand Five Hundred and Forty Eight dollars and Sixty Four cents ($2,548.64) to Twenty Seven Thousand Five Hundred and Forty Eight dollars and Sixty Four cents ($27,548.64).
