A Resolution Approving a Final Plan on Lot 5 for Unit 3 of Butterfield East Subdivision located East of Duke Parkway north of Ferry Road (Duke Realty - L16-00245 / WI33/4-16.010-Fpn - TV - Ward 10)
PURPOSE:
The Petitioner, Duke Realty, is requesting approval of a Final Plan for Lot 5 of Butterfield East, Unit 3 for a warehouse and distribution facility.
BACKGROUND:
The Subject Property is located east of Duke Parkway north of Ferry Road and is currently vacant. The property is part of the Butterfield East Planned Development and is zoned PDD Planned Development District. Additional information on the legislative history of the property can be found in the attached Property Information Sheet.
The details of the proposal include the construction of 954,720 square foot warehouse and distribution facility housing 180 docks. There will be 240 trailer parking spaces and 512 automobile parking spaces being provided which meets the varied parking requirement approved at the Preliminary Plan and Plat time. An administrative variance is being requested as part of proposal to allow for a minor encroachment of the trailer parking and drive aisle within the required setback due to the non-rectangular shape of the site.
The Final Plan proposal also includes a full Landscape Plan to be implemented throughout the Lot. The building elevation consists of precast concrete panels which is consistent with the other building in this development. Stormwater detention for this lot has already been provided as part of the overall subdivision.
As part of this application, the Petitioner will be constructing Duke Parkway extension along the north property line which will cul-de-sac at the east end of Lot 5 until the long range plan of the ultimate connection to State Route 59 occurs.
Concurrently with this proposal, the Petitioner is also proposing a Plat of Vacation and Plat of Easement to adjust certain city easements so that they correspond with the proposed the location of the utilities.
DISCUSSION:
Staff has reviewed the Final Plan petition and has sent comments back to the petitioner on those submittals. The petitioner has made the requested revisions to these documents and they now meet the applicable codes and ordinances, with the exception of the items mentioned in the Staff Recommendation listed below. The petitioner is proposing a combination of a 10' ornamental fence (located north of the building) and a 10' chain linked fence (located east and south of the building) which does not meet the fence height regulations set forth in the Aurora Zoning Ordinance. Therefore, a condition has been added to reduce the height of the fence from 10' to 8' in order to meet this requirement.
POLICIES AND GUIDELINES:
The Staff’s Evaluation and Recommendation are based on the following Physical Development Policies:
10.0 To provide for the orderly, balanced and efficient growth and redevelopment of the City through the positive integration of land use patterns, functions, and circulation systems. To protect and enhance those assets and values that establishes the desirable quality and general livability of the City. To promote the City’s position as a regional center.
11.0 To guide the growth of the City in an orderly and structured manner
40.1(1) To attract and encourage industrial, office and office-research development to planned sites where requisite public facilities are either present or proposed.
RECOMMENDATIONS:
The Planning Commission recommends CONDITIONAL APPROVAL of the Resolution Approving a Final Plan on Lot 5 for Unit 3 of Butterfield East Subdivision located east of Duke Parkway north of Ferry Road, with the following conditions:
1. That the documents be revised to incorporate the Fire Prevention Bureau Staff comments included in the memo dated March 29, 2016 prior to building permit issuance which shall be contingent upon Fire Access Plan approval.
2. That the landscaping on the north property line be adjusted so that it does not interfere with the overland flood route.
3. That the fence height be reduced from ten (10) feet to eight (8) feet.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS, by petition dated March 9, 2016, Duke Realty Ltd Partnership filed with the City of Aurora a petition requesting approval of a Final Plan for Lot 5 of Butterfield East, Unit 3 for a Warehouse, Distribution and Storage Services Facility
WHEREAS, after referral of said petition from the Aurora City Council, the Aurora Planning Commission on April 6, 2016, reviewed the petition and recommended CONDITIONAL APPROVAL of said petition; and
WHEREAS, on April 14, 2016, the Planning and Development Committee of the Aurora City Council reviewed said Final Plan and the before mentioned recommendations and recommended CONDITIONAL APPROVAL of said petition; and
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Aurora, Illinois, finds as facts all of the preamble recitals of this Resolution and hereby grants CONDITIONAL APPROVAL of said Final Plan with the following conditions:
1. That the plan be revised to reflect that Duke Parkway Extended be built as part of Phase 1.
2. That the landscaping on the north property line be adjusted so that it does not interfere with the overland flood route.
BE IT FURTHER RESOLVED that the City Council of the City of Aurora hereby adopts the Final Plan and related required documents, subject to Final Engineering approval, as attached hereto as Exhibit "A-1" Final Plan, Exhibit “A-2” Landscape Plan, Exhibit “A-3” Building and Signage Elevations, and Exhibit “A-4” Fire Access Plan along with any dedications deemed necessary by the Aurora City Engineer.
