A Resolution authorizing the Mayor to execute an amended Phase 2 Local Agency Agreement with the Illinois Department of Transportation for the McCoy and Commons Signal Modernization and Interconnect.
PURPOSE:
To amend the Phase 2 Local Agency Agreement with the Illinois Department of Transportation for the McCoy and Commons Signal Modernization and Interconnect to match the Preliminary Engineering Services Agreement Supplement #1 approved by Council May of 2013.
BACKGROUND:
In May of 2013, council approved a supplement to the preliminary engineering services agreement approved in February of 2012. The supplement was required in order to expand the limits of the Commons Drive interconnect from New York Street as the northern limit to Liberty Street as the revised northern project limit.
In doing so, the City is required to execute a revised Local Agency Agreement in order to receive reimbursement for increase in phase 2 engineering.
DISCUSSION:
Staff has attached the original phase 2 local agency agreement from February 2012 and the proposed revised Local Agency Agreement. The difference as approved in May of 2013 is $15,750.00. The City has already funded the engineering and is eligible for reimbursement of 80% or $12,600.00 upon execution of the revised Local Agency Agreement.

Staff recommends Council authorize the Mayor to execute an amendment to the Phase 2 Local Agency Agreement with the Illinois Department of Transportation for the McCoy and Commons Signal Modernization and Interconnect.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS, the City has completed and funded the Preliminary Engineering Services Agreement Supplement #1 approved by Council May of 2013.
WHEREAS, the City desires to amend the February 2012 Phase 2 Local Agency Agreement with the Illinois Department of Transportation for the McCoy and Commons Signal Modernization and Interconnect to reflect the said Supplement#1
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: authorizes the Mayor to execute an amended Phase 2 Local Agency Agreement with the Illinois Department of Transportation for the McCoy and Commons Signal Modernization and Interconnect
