SUBJECT:

Approval of a Resolution authorizing the execution of an Artistic Mural Agreement. 

 

PURPOSE:

The Artistic Mural Agreement is needed in order to permit the City to mount its Blues Mural on 6 East Downer Place. The building is not owned by the City of Aurora and many issues are spelled out in the agreement. 

 

BACKGROUND:

The City of Aurora commissioned a Blues Mural in 2008.  It was painted by a collaboration of artists under the direction of Patrick Kirwin of Alexandria Virginia for the Salon Forever in Aurora hosted by the Painters and Allied Trades Council 30 in 2008.  It was displayed as part of the event and has been in storage since that time.

 

DISCUSSION:

The Aurora City Council recently adopted a new section 8.4 "Murals" of the FoxWalk Overlay District Design Guidelines, Regulations and Procedures.  The changes were made in order to streamline the process for murals in the downtown. The ordinance change was prompted by recent interest in murals.  

 

The cost for the mural installation is below the threshold requiring city council approval.  The cost for this work will be covered by the Public Art Division.

 

IMPACT STATEMENT:

This project will result in minimal impact outside of the initial purchase price of the mural and the installation cost.  The mural already has a protective coating. However going forward additional applications of a protective coating will extend the life of the mural since it is exposed to the elements. 

 

RECOMMENDATIONS:

Staff recommends approval of this resolution.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, the City of Aurora purchased the Blues Mural in 2008 and:

 

WHEREAS, the City of Aurora desires to display the mural for public enjoyment and;

 

WHEREAS, an Artistic Mural Agreement is needed to permit the installation of the mural on 6 East Downer Place, Aurora IL, and

 

WHEREAS, the installation of the City's Blues Mural is permitted under Section 8.4 of the FoxWalk Overlay District Design Guidelines and has been approved by the FoxWalk Overlay District Design Review Committee.

 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows:  That the Mayor is authorized to execute the Artistic Mural Agreement, a copy of which is attached hereto and incorporated herein by reference.
