Ordinance authorizing the sale of City Real Estate (the southerly half of LOT 6) at 226 High 

Street, Aurora, Illinois, Permanent Index No.: 15-22-426-046

 

PURPOSE:

Attached is an Ordinance authorizing the sale of the City real estate, the southerly half of Lot 6, commonly known as 226 High Street, with PIN 15-22-426-046, to Ramiro R. Leon, who own the property directly north of the area to be sold (230 High Street). Under the terms of the proposed sale, Leon will pay the City one dollar ($1.00) and consolidate the land with his current parcel. This sale includes all of said property PIN 15-22-426-046..

 

BACKGROUND:

In April 2007 the City of Aurora accepted a Quit Claim deed for the property at 226 High Street, Aurora, Illinois (the southerly half of Lot 6) from Ann Wohlabaugh. The structures on the property are raised and the lot is vacant. The property is currently exempt from real estate taxes. The lot is to be rejoined with the northerly half of Lot 6, and given to that adjoining land owner (Leon) as legally described below:

 

THE SOUTHERLY HALF OF LOT 6 IN BLOCK 6 OF BARR AND YUNG’S ADDITION TO AURORA, IN THE CITY OF AURORA, KANE COUNTY, ILLINOIS.

 

DISCUSSION:

The City has made this type of arrangement before with adjacent owners in order to dispose of vacant City-owned lots.

 

IMPACT STATEMENT:

Transfer of the property to the adjoining property owner will move parcel back to the City tax rolls and remove parcel from City maintenance.

 

RECOMMENDATIONS:

 Place on Finance Committee Calendar (6/13/17 Agenda) for approval to City Council.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, the City of Aurora is interested in selling and Ramiro R. Leon is interested in purchasing real estate known as the southerly half of Lot 6 in Block 6 of Barr and Young’s Addition to Aurora, in the City of Aurora, Illinois with PIN Number 15-22-426-046 (“Property”) in accordance with the terms and restrictive covenant set forth in the attached Agreement.

 

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Aurora, Illinois, as follows: that the attached Agreement for the sale of the southerly half of Lot 6 in Block 6 of Barr and Young’s Addition to Aurora, in the City of Aurora, Illinois for the sum of $1.00 is hereby approved.  Additionally, Chuck Nelson is hereby authorized to act on the City’s behalf to complete the sale of these properties.
