SUBJECT:

To sell a small portion of the City's former landfill to Heartland Recycling LLC to allow for Heartland to fill in a swale/valley area between the two properties, increasing the amount of developable land, and being able to dispose of additional materials.

 

 

PURPOSE:

Heartland Recycling is currently filling the former quarry (bought from the City of Aurora) with clean construction debris, the goal of which is to redevelop the site when the quarry is ultimately filled and graded. Being able to fill this additional area provides for additional land in which to build upon when the filling is completed.

 

 

BACKGROUND:

The City property being considered for sale consists of approximately .66 acre in size, immediately south of Heartlands quarry site, and running from State Rt. 25 to the east. Heartland states that the filling of the quarry is ahead of schedule, and being able to utilize this additional area for clean construction debris, including for the City’s public works projects, will level off the valley and become a part of any proposed future use of the quarry site, more than likely an office, research or industrial use.

 

 

DISCUSSION:

The City, as part of the original agreement, will be provided with 15 acres of the quarry site free of charge. This area will be determined upon completion of the filling at the site and pursuant to a subdivision of the property.

 

 

IMPACT STATEMENT:

This sale will have a positive impact on the future redevelopment of the site, which in turn will increase the tax revenues at the site.

 

 

RECOMMENDATIONS:

It is recommended that the Contract for the Purchase and Sale of a Portion of City Owned Real Estate Located the Northeast Corner of Sullivan Road and State Route 25 be approved.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, The City of Aurora is interested in selling and Heartland Recycling LLC is interested in purchasing a portion of City owned land consisting of approximately .66+/-acres; and

 

WHEREAS, Heartland Recycling LLC owns the former quarry immediately to the north of this parcel and continues to operate the property as a Clean Construction Debris Disposal (CCDD) facility; and

 

WHEREAS, Heartland Recycling LLC desires to use this portion of City owned property to fill with clean construction debris, thereby allowing for more developable land once filled and graded, increasing the tax base for the property; and

 

WHEEAS, it is in the best interest of the City of Aurora and its residents to sell a portion of its property to Heartland Recycling LLC for a price of Sixteen Thousand Five Hundred Dollars ($16,500)

 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows:

 

1.                     That the Mayor of the City of Aurora be authorized to execute the Contract for the Purchase and Sale of Real Estate attached hereto and made a part thereof as Exhibit A.

 

2.                     That a Plat of Survey identifying the portion of property being sold be provided by the City of Aurora prior to closing.

 

3.                     That the Corporation Council for the City of Aurora, or his/her designee, be authorized to complete the sale of property on the City's behalf.
