A Resolution approving a right of way agreement with Presence Health for the southeast corner of Highland Avenue and Sullivan Road
PURPOSE:
To approve an agreement to acquire the right of way required for the construction of the Highland and Sullivan roundabout from Presence Health on the southeast corner of the stated intersection.
BACKGROUND:
The City plans to construct a roundabout at the intersection of Highland and Sullivan in late 2015. Staff has been working with Presence Health for the acquisition of the required right of way.
Concurrently, Presence Health is in the process of expanding the existing parking lot for McCauley Manor located on the southeast corner of the site. Through the process it was agreed that Presence Health would provide the right of way and in consideration the roundabout project would modify the adjacent detention facility to accommodate the required increase detention due to the parking lot expansion.
DISCUSSION:
Staff has attached the agreement and the detention calculations that provided the sizing of the modification to the detention facility.
No direct funds will be transferred in this transaction.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS, the City requires additional right of way for the construction of a roundabout at the intersection Highland Avenue and Sullivan Road
WHEREAS, Presence Health is required to provide additional detention for a proposed parking lot expansion at McCauley Manor
WHEREAS, an agreement was established to provide right of way to the City of Aurora in consideration for providing the required detention for the McCauley Manor parking lot expansion)
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: the Mayor is hereby authorized to approve a right of way agreement with Presence Health for the southeast corner of Highland Avenue and Sullivan Road
