Resolution authorizing the Mayor and City Clerk to renew an intergovernmental agreement (IGA) with the Fox Metro Water Reclamation District (FMWRD) for work related to the City's combined sewer overflows (CSO).
PURPOSE:
This IGA provides the means for the City and Fox Metro to cooperate in meeting certain requirements of each organization's National Pollutant Discharge Elimination System (NPDES) permit.
BACKGROUND:
The 1994 US EPA CSO Control Policy requires that the City and FMWRD continuously monitor and document the occurrences of overflows from all CSOs within the City. The City owns fourteen CSOs and the FMWRD owns one CSO within Aurora. The outfalls are permitted through the NPDES permit program.
The CSO monitoring consists of maintaining and downloading information from flow monitors that are installed within each overflow structure. Information from each flow monitor is used to prepare reports that must be sent to the IEPA on a monthly basis. Aurora and FMWRD have been sharing the cost of this work since 1996.
DISCUSSION:
The 2019 budget provides $100,000 in the Water and Sewer Fund in account No. 510-4063-511.73-13.
IMPACT STATEMENT:
Renewing this IGA will reduce the cost for Aurora to meet its NPDES obligations.
RECOMMENDATIONS:
I respectfully request that this resolution be adopted.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS, the Illinois Environmental Protection Agency requires that the discharge from all combined sewer overflows within the City of Aurora be monitored on a continuous basis; and
WHEREAS, the City of Aurora and Fox Metro Water Reclamation district have a long history of cooperating in the monitoring of the combined sewer overflows within the City of Aurora; and
WHEREAS, the parties have elected to renew the Agreement regarding the cooperation between the two organizations for the monitoring of the combined sewer outfalls and the sharing of the costs thereof, which said Agreement is attached hereto as Exhibit "A"; and
WHEREAS, said Agreement is for a five year period; and
WHEREAS, the 2019 Budget provides funding for this work in the Water and Sewer Fund in account No. 510-4063-511.73-13;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: The Mayor and City Clerk are hereby authorized to enter into an agreement with the Fox Metro Water Reclamation District for the work related to monitoring the combined sewer overflows in accordance with attached Exhibit "A".
