A Resolution Authorizing Assistance Under the Single Family Restoration Program - a Forgivable Loan for 535 West Downer Place, (Nichole Allen, Owner), Two Units Reduced to One Unit - 4th Ward
 
PURPOSE:
Staff requests that property address, 535 West Downer Place, (Nichole Allen, Owner), be approved under the 2013 Single Family Restoration Program (R13-274)("Program"), using funds from account, 215-1330-463-50-13. The owners have requested a forgivable loan in the amount of $10,000 for a one unit removal. The Program provides forgivable loans to homeowners to remove additional apartment units created in a structure or on a parcel where the original use was for a single-family or duplex residence.
 
BACKGROUND:
Originally approved by the City Council as the Reconversion Incentive Program in 1994, the old program spent over $5 million reducing over 200 units primarily in older Aurora homes.   The overall goal in these reconversion incentives is to reconvert homes to their original single family status, which will benefit not only the neighborhoods but also the property owners.  Neighborhood Redevelopment Division staff updated the program based on the old model and like programs in other cities (e.g., Springfield) and reintroduced the new Program guidelines in September of 2013.
 
DISCUSSION:
The Program goal is to reconvert homes to their original status, which will benefit not only the neighborhoods but also the property owners.  Applications that can show a significant impact on the neighborhood are given priority within the program.
 
IMPACT STATEMENT:
The Program provides an incentive to restore residential units to their original configuration, to reduce density, reduce the demand for on-street parking, eliminate blighted conditions, and to improve the quality of life in Aurora by reducing the number of multi-family rental units in neighborhoods originally designed for single family housing.
 
 
RECOMMENDATIONS:
Staff requests that the abovementioned address be approved for the 2013 Single Family Restoration Program as it has proven to adhere to the guidelines and goals of the Program.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
 
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
 
WHEREAS, the  Aurora  City  Council  has  made the conservation of Aurora's older neighborhoods a major priority; and
 
WHEREAS, the  City  of  Aurora  adopted guidelines for the Single Family Restoration Program in Resolution Number R13-274; and
 
WHEREAS, the owners have requested $10,000 of the Single Family Restoration Program funds to reconvert 535 West Downer Place from two (2) units to one (1) unit; and
 
WHEREAS, the 2014 City Budget provides $10,000 for this item in account no. 215-1330-463-50-13(Special Programs/Reconversion Incentive); and
 
WHEREAS, the owners have agreed, according to the Single Family Restoration Program to request a rezoning of the property and to allow the City of Aurora to file a deed restriction on the property, and has also agreed to all other terms and conditions of the Single Family Restoration Program; and  
 
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: that $ 10,000 be approved for the rehabilitation of 535 West Downer Place in accordance with the Single Family Restoration Program guidelines, and that the Mayor of the City of Aurora is hereby authorized to act on the City's behalf to complete Single Family Restoration Program awards, and is authorized to sign all agreements, notes, liens, and other necessary documents on behalf of the City of Aurora.
