Resolution Authorizing the Acquisition of Property from Kane County for Right-of-Way Road Purposes for the Sullivan Road and Highland Avenue Roundabout Intersection Improvements Project, Partial Acquisition PIN: 15-09-400-009, 1330 N. Highland Avenue.
PURPOSE:
Acquisition of property for right of way roadway purposes at the southwest corner of
Sullivan Road and Highland Avenue in Aurora, Illinois from Kane County for the Sullivan Road and Highland Avenue Roundabout Intersection Improvements Project.
BACKGROUND:
The City Council approved a resolution approving the Professional Engineering Services Agreement with HW Lochner Inc. for the design of the Highland and Sullivan Roundabout on May 14, 2013 Resolution No. R13-141. Acquiring the necessary right of way to facilitate this design has been an ongoing process of which this acquisition is concludes.
DISCUSSION:
It is necessary for the City to acquire 0.062 acres of land (2678 square feet) more or less of the parcel located at 1330 N. Highland Avenue for road purposes. The City has negotiated an agreed upon amount with Kane County for said acquisition based on the valuation analysis attached hereto (exhibit A). The Kane County Board passed resolution No. 15-231 on August 11, 2015 approving the sale of the County property to the City in the amount of $8,700.00 (exhibit B). The Law Department has reviewed the attached documents approving the sale of said partial parcel 15-09-400-009 for right-of-way construction purposes from the Kane County Board. This is the only remaining acquisition of land that is necessary in order for this Project to proceed. Funding for this acquisition is provided in the 2015 budget in account # 340-4460-431-73-23 (GB 120).
IMPACT STATEMENT:
Unable to proceed to complete the project without this acquisition.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS, the City of Aurora has determined it is in the best interests of its citizens that certain real estate be acquired for right-of-way road purposes for the Sullivan Road and Highland Avenue Roundabout Intersection Improvements Project (partial acquisition PIN: 15-09-400-009, 1330 N. Highland Avenue, Aurora, Illinois 0.062 acres of land 2678 square feet more or less), from property owned by Kane County; and
WHEREAS, the Kane County Board has agreed to sell and the City has agreed to purchase land in the proposed right of way for the sum of Eight Thousand Seven Hundred and 00/100 Dollars ($8,700.00). Copies of the appraisal (Exhibit “A”), Kane County resolution approving sale along with the legal description of the land to be acquired (Exhibit “B”) and plat of plat of dedication (Exhibit “C”.) are attached hereto; and
WHEREAS, the 2015 City Budget provides funds for this item in account no. 340-4460-431-73-23 (GB 120).
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: that the purchase of the herein described land for the proposed right-of-way for the Sullivan Road and Highland Avenue Roundabout Intersection Improvements Project from Kane County, for the sum of Eight Thousand Seven Hundred and 00/100 Dollars ($8,700.00) is hereby authorized, and further, the issuance of a draft payable to Kane County in the amount of Eight Thousand Seven Hundred and 00/100 Dollars ($8,700.00) is authorized. Attorney Blanca R. Dominguez is hereby authorized to act on the City’s behalf to complete the purchase of this property.
