PURPOSE:
The Petitioner, WDS Real Estate, Inc. / Chicago Premium Outlets, is proposing a Final Plan and Plat for the construction of a parking lot with 349 spaces along with detention and storm sewer located at 1923 Bilter Road.   
 
BACKGROUND:
This Rezoning and Variance petition was referred by the City Council to the Planning & Zoning Division on August 19, 2014.  The petition was unanimously moved forward by the Planning Council on September 2, 2014.  
 
DISCUSSION:
The proposal consists of expanding the existing Chicago Premium Outlet (CPO) mall onto the Subject Property.
 
This property has been used by Western DuPage Landscaping.  The property will be razed.  The Final Plan is to allow for a 349 vehicle parking lot with stormwater detention to be added to the existing mall.  8.5 foot parking stall widths as was done in the rest of the mall to maximize parking is proposed.  Overall parking will increase to approximately 4,441 spaces, for an overall parking ratio of 1 space per 165 square foot of gross floor area, and improvement from the current 1/179 ratio and better than the required 1/200 in the AZO.  Two access points to improved Sealmaster Drive will be constructed, and the entire property will be landscaped.  With the Final Plat, Stormwater detention will be provided on Lot 2 and the parking lot on Lot 1.  The intersection of private Sealmaster Drive (to be renamed Chicago Premium Outlet Boulevard) and Bilter Road is being improved with turning lanes and traffic signals.
 
Staff has not received any public input on this petition.  
 
IMPACT STATEMENT:
The Planning and Zoning Division would anticipate that this project will increase the City's overall tax base and viability by facilitating investment and development.   
 
RECOMMENDATIONS:
Staff recommends CONDITIONAL APPROVAL of the Final Plan and Plat Petition at 1923 Bilter Road to allow for construction of a 349 space parking lot and stormwater detention, with the following conditions:
1.  Through the engineering plan review process, the stormwater management facility may  be revised to meet all ordinances and City requirements which could result in a change to the detention basin geometry which then could result in alteration of the  parking lot and the lot lines for the plat of subdivision.
2.  A left turn lane shall be installed by Developer on Premium Outlet Blvd. for the southerly access to the parking lot.          
3.  Developer shall install an 8 foot wide asphalt path in the right of way along the South right of way line of Bilter Road along the property frontage.
4. All plans and plats and any changes thereto pursuant to the above conditions shall be subject to the approval of the City Engineer.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
 
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
 
WHEREAS by petition dated August 19, 2014, WDS Real Estate, Inc. / Chicago Premium Outlets filed with the City of Aurora requesting a Final Plan and Plan for the property described on Exhibit "A" attached hereto; and
 
WHEREAS, on September 3, 2014, the Aurora Planning Commission reviewed said Final Plat and Plan and recommended CONDITIONAL APPROVAL of said petition; and
 
WHEREAS, on September 11, 2014, the Planning and Development Committee of the Aurora City Council reviewed said Final Plat and Plan and before mentioned recommendations and recommended CONDITIONAL APPROVAL of said petition; and   
 
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Aurora, Illinois, finds as facts all of the preamble recitals of this Resolution and hereby grants CONDITIONAL APPROVAL of said Rezoning with the following conditions:
 
1.  Through the engineering plan review process, the stormwater management facility may be revised meet all ordinances and City requirements which could result in a change to the detention basin geometry which could then result in alteration of the parking lot and the lot lines for the plat of subdivision.
