Update on Ordinance Amending "Chapter 25, Article X-II "Mobile Food Unit Vendors".

PURPOSE:

Provide update and revised schedule on the moratorium regarding Mobile Food Unit Vendors to the Rules, Administration and Procedures (RAP) Committee.

 

BACKGROUND:

On November 22, 2022 the City Council approved a moratorium on the issuance of new licenses for Mobile Food Unit Vendors in the City of Aurora. The moratorium is currently scheduled to expire on Tuesday, February 28th.

 

DISCUSSION:

City staff representatives comprised of members of the Mayor's Office and Law Department began working through the process of amending the current ordinance. Regular reports have been provided to the RAP Committee on the process and progress of the proposed ordinance revisions.

 

The changes staff will be recommending to the Committee do not present a significant change to the ordinance itself but will be a change to the mobile food units operating on a regular basis in the city. It is with this in mind that staff has scheduled a time to meet with the mobile vendors and explain the proposed changes before passage of the revised ordinance. To accommodate the meeting as well as enough time for the RAP Committee to review, staff is proposing to extend the moratorium, which is an item on new business on the Tuesday, February 7, 2023 Committee of the Whole Agenda.

  

In order to continue the process for the committee, staff will be presenting the revised definition section to RAP. This section underwent changes and will be a key part in addressing a number of the challenges this revision seeks to address.

 

IMPACT STATEMENT:

The additional time will have a positive impact on the passage of this revised process.

 

RECOMMENDATIONS:

Staff requests continued feedback from the RAP Committee in order to move this process forward.
