A Building, Zoning, and Economic Development Committee Resolution Approving a Final Plan for the Property located at the Southeast Corner of North Eola Road and Weber Drive, for a Business and Professional, Office (2400) use and a Warehouse, Distribution, and Storage Services (3300) Use (Ground Effects Outdoor Living, LLC - 20-0316 / NA20/1-20.022-Fpn - SB - Ward 10)
PURPOSE:
The Petitioner, Ground Effects Outdoor Living, LLC, is requesting approval of a Final Plan for the property located at the southeast corner of North Eola Road and Weber Drive, for a Business and Professional, Office (2400) use and a Warehouse, Distribution, and a Storage Services (3300) use, which includes the construction of an approximately ten thousand, five hundred (10,500) square foot building, outdoor storage bins, and permeable pavers.
BACKGROUND:
The Subject Property is currently zoned B-2(S), Business District - General Retail with a Special Use Planned Development. The subject property was incorporated in 2004 to allow for continuing use for storage and sale of landscaping materials, in addition to residential retail sales of seasonal items like fruits, vegetables, and Christmas trees. The subject property is approximately 6.73 acres and contains a single-family home and storage buildings for a similar landscaping storage business. Additional information on the legislative history of the property can be found in the attached Property Research Sheet.
The Petitioner is requesting approval of a Final Plan for the property located at the southeast corner of North Eola Road and Weber Drive for a Business, and Professional Office (2400) use and Warehouse, Distribution, and Storage Services (3300) use. In addition to development of the approximately 10,500 square foot building, there will be screened storage bins for landscaping materials, and a new access point on Weber Drive for employees and contractor trucks. Approval of this Final Plan will allow for development on this site for the first of two phases of development on the subject property by the Petitioner.
DISCUSSION:
Staff has reviewed the Final Plan petition and have sent comments back to the Petitioner on those submittals. The Petitioner has made the requested revisions to these documents and they now meet the applicable codes and ordinances.
POLICIES AND GUIDELINES:
The Staff’s Evaluation and Recommendation are based on the following Physical Development Policies:
31.1 (3): To promote the development of commercial facilities in existing or planned
commercial areas.
41.1 (2): To promote a balanced distribution of industries within the City.
51.1 (6): To promote the location and expansion of commercial activities within the
City consistent with the Comprehensive Plan.
RECOMMENDATIONS:
The Planning Commission recommended APPROVAL of the Building, Zoning, and Economic Development Committee resolution, approving a Final Plan for the property located at the southeast corner of North Eola Road and Weber Drive, for a Business and Professional, Office (2400) use and a Warehouse, Distribution, and Storage Services (3300) use.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS, by petition dated June 3, 2020, Ground Effects Outdoor Living, LLC filed with the City of Aurora a petition Requesting Approval of a Final Plan for the Property located at 7S343 N. Eola Road, for a Retail, Sales, and Services (2100) use and a Warehouse, Distribution, and Storage Services (3300) Use and related required documents as attached hereto as Exhibits "A-1" through Exhibit “A-3”; and
WHEREAS, after referral of said petition from the Aurora City Council, the Aurora Planning Commission, on June 17, 2020, reviewed the petition and recommended APPROVAL of said petition; and
WHEREAS, on June 24, 2020, the Building, Zoning and Economic Development Committee of the Aurora City Council reviewed said Final Plan and the before mentioned recommendations and recommended APPROVAL of said petition; and
WHEREAS, the decision of the Building, Zoning and Economic Development Committee with respect to a final plan is subject to appeal to the City Council in the manner set forth in the City of Aurora Zoning Ordinance; and
WHEREAS, no person authorized under City of Aurora Zoning Ordinance to appeal such decision having done so in the manner set forth in the Ordinance, the Decision of the Building, Zoning and Economic Development Committee constitutes final action on the proposed final plan; and
NOW, THEREFORE, BE IT RESOLVED that the Building, Zoning and Economic Development Committee of the City of Aurora, Illinois, finds as facts all of the preamble recitals of this Resolution and hereby grants APPROVAL of said Final Plan.
BE IT FURTHER RESOLVED that the Building, Zoning and Economic Development Committee of the City of Aurora hereby adopts the Final Plan and related required documents, as attached hereto as Exhibit "A-1" Final Plan, Exhibit “A-2” Landscape Plan, and Exhibit “A-3” Building and Signage Elevations, along with any easement dedications or vacations deemed necessary by the Aurora City Engineer.
