SUBJECT:

A Resolution to execute the Intergovernmental Agreement between City of Aurora, Illinois and Aurora Civic Center Authority (ACCA) for the Paramount Riverwalk Promenade and North Island Center Plaza improvements.

 

PURPOSE:

The Agreement will set the basis for administration of the Paramount Riverwalk Promenade and North Island Center Plaza projects between the City and ACCA.

 

BACKGROUND:

The Paramount Riverwalk Promenade is a concrete and brick walkway that overhangs the Fox River and connects sidewalks from Downer Place to Galena Boulevard. The walkway is supported by concrete encased steel cantilevered beams from the adjacent Paramount buildings. The Promenade was determined to be in fair to poor condition with spalled and deteriorating concrete, exposed rebar and extensive deterioration to some structural elements.  The Promenade is partially owned by ACCA and partially owned by the City and is in need of repair and rehabilitation.

 

ACCA owns and operates an office building, theater, and banquet facility called the North Island Center which has a Plaza in front of the building that is in need of repair and reconstruction.

 

DISCUSSION:

ACCA and the City of Aurora requested financial assistance for these two projects through a potential State Capital Bill.  In June 2019, the State of Illinois enacted a package of legislation to fund transportation, water infrastructure, natural resources, open space, school construction, affordable housing, and other projects. Appropriations for the capital package are found in multiple pieces of legislation that were approved together during the General Assembly’s spring session, with most of the specific projects and programs in one piece of legislation, Public Act 101-0029.

 

The State Capital Bill appropriated $725,000 to ACCA for the Paramount Riverwalk Promenade improvements and $225,000 to the City for the North Island Center Plaza improvements

 

The Intergovernmental Agreement (IGA) is attached as 'Exhibit 1'.  The IGA with ACCA will set the basis for administration of the projects as they move forward.

 

The City previously hired HR Green, Inc. to work on preliminary and final engineering.  HR Green, Inc. is currently working on detailed plans and specifications in agreements passed by the City (R19-071 & R20-032).

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, it is necessary and desirable to make repairs to the Paramount Riverwalk from Downer Place to Galena Boulevard; and

 

WHEREAS, it is necessary and desirable to make repairs to the North Island Center Plaza; and

 

WHERAS, the June 2019 State Capital Bill providing funding for both projects; and

 

WHEREAS, entering into the IGA will allow the City and ACCA to progress the projects further.

 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: that the Mayor and City Clerk are hereby authorized to execute the Intergovernmental Agreement between City of Aurora, Illinois and Aurora Civic Center Authority (ACCA).

 

BE IT FURTHER RESOLVED that the Mayor is hereby authorized to execute any other related Agency Documents or Permit items that may be required for advancement and completion of said projects.
