SUBJECT:

To obtain City Council approval for the sale of surplus land, known as Parcel 33-2 located at the Aurora Municipal Airport to the Sugar Grove Park District

 

PURPOSE:

The sale of this surplus land will generate $635,000 of revenue that will be used to fund projects at the airport.

 

BACKGROUND:

The City of Aurora currently has an agreement with the Village of Sugar Grove allowing them to use the baseball fields on the airport property until the expiration of the agreement, July 14, 2018.

 

The concept of selling the ballfield property was the result of a Land Use Compliance Inspection conducted by the FAA in July of 2009 (report attached).

The City of Aurora was also approached by the Village of Sugar Grove, on behalf of the Sugar Grove Park District in May of 2014 at which time the Sugar Grove Park District expressed interest in buying the athletic field property.

 

The City met with the FAA Airports District Office in Chicago in June of 2014 to begin the Land Release process.

 

It wasn't until December of 2017 that the land release had been completed, enabling the transfer of the 26.67 acres to the Sugar Grove Park District.

 

The terms, conditions and required easement have been reviewed by the City's Corporation Counsel and airport consultant as well as the Sugar Grove Park District's staff and Counsel.

Once approved, this matter will go before the Park District's board for their approval.

 

DISCUSSION:

The sale of this property will benefit the City of Aurora in two ways.  First, it will satisfy the FAA's compliance issue regarding the inconsistent use of airport property.  Second, it will help fund many of the needed projects at the airport.

 

Since federal funds were used to acquire the original parent Parcel 33 for the construction of new runway 15-33, proceeds from the sale of Parcel 33-2 are restricted to airport-related expenditures.

 

IMPACT STATEMENT:

The sale of Parcel 33-2 will have no adverse impact on the City of Aurora.

 

RECOMMENDATIONS:

We respectfully request approval of this resolution authorizing the sale of 26.67 acres of surplus land to the Sugar Grove Park District.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, the Corporate Authorities of the City of Aurora have received An Intergovernmental Agreement Between The City of Aurora And The Sugar Grove Park District In Regard To The Use And Conveyance Of Parcel 33-2 Of The Aurora Municipal Airport, a copy of which is attached hereto as Exhibit “1” and made part hereof (the “IGA”); and

 

WHEREAS, the Corporate Authorities of the City of Aurora deem it to be in the best interests of the City of Aurora to approve said IGA.

 

 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows:

 

SECTION 1: That the IGA attached hereto as Exhibit “1” is hereby approved.

 

SECTION 2: That the Mayor and City Clerk are hereby authorized and directed to sign the IGA on behalf of the City of Aurora.

 

SECTION 3:  That this Resolution shall be in full force and effect from and after its adoption and approval as required by law.
