SUBJECT:

Resolution to award a contract to HR Green, Inc. for design engineering services for the design of retention basins and the preliminary design for the potential extension of Commons Drive between Ogden Avenue and 75th Street (Ward 10 and Ward 8).  The contract will be in the amount of $182,000.

 

PURPOSE:

This resolution and agreement is needed to  comply with the Redevelopment Agreement with Aurora Town Center Associates (ATCA) in the design of retention facilities at and around the development site at the Ogden and 75th Street TIF. 

 

BACKGROUND:

The City and ATCA executed a Redevelopment Agreement in early 2019 regarding the triangular parcel east of the intersection of Ogden Avenue and 75th Street.  ATCA’s proposed development consists of four phases, as indicated in Exhibit B.   As a part of the four phase redevelopment of the triangle bordered by Ogden Ave, 75th Street, and the future Commons Drive the City is responsible for certain retention costs as well as the construction of a Commons drive extension.  The design of a Commons Drive extension is only required after the completion of Phase 1 of the project and after design of Phase 2 has been initiated.  The Commons Drive extension only needs to be completed at the same time as the completion of Phase 2 of the development.  Practically speaking it may be in the City’s best interest to work with the developer to complete the design of the Commons Drive extension somewhat sooner, but unfortunately the funding of the project to complete the extension relies on both Phases being completed in order for the Tax Increment to pay for the bonds for the project.  This issue involves the integration of the site and the building of the road.  ATCA is currently designing Phase 1, but starting the design of Commons Drive now could ensure the road can be built without importing or exporting an excessive amount of soil.  

 

Due to this situation, City staff requested that both the road and the site/drainage design be included in the RFQ detailed below.

 

As part of the Redevelopment Agreement, the City is required to complete certain drainage improvements and to extend Commons drive from Ogden Avenue to 75th Street when ATCA is ready to start construction of Phase 2.  As is defined in the RDA, there is substantial time allowed between the start of design of Phase 1 and the completion of Phase 2.  A project location map is included as Exhibit A.

 

 

DISCUSSION:

The City issued a Request for Qualifications on August 19, 2020 to over 300 vendors in the Professional Services category.  Statements of Qualifications were received from sixteen (16) firms on September 4, 2020.  This was a qualifications-based selection process for professional services.  Since it was qualifications-based, the Local Vendor Preference Ordinance does not apply.

 

HR Green was selected as the most qualified firm by a three (3) person panel from the Engineering Division.  Exhibit C shows how the Statements of Qualifications were scored.  After being notified of their selection, HR Green prepared the proposal included as Exhibit D.  Account 225-4460-431.73-23 has a balance of $182,000, which will cover the initial Purchase Order for the retention design work associated with site work for the development and if possible any coordination of this work with the future Commons Drive design.  This work is expected to be completed by April 1, 2021.  The remainder of the design work associated with Commons Drive will take place after the completion of Phase 1 and the start of design of Phase 2  in late 2021 or 2022.  No work for further design will be requested until design plans have been submitted by ATCA for Phase 2.    Additional funds have been requested in the 2021 budget in the event that Phase 1 is completed and Phase 2 begins design.

The proposed improvements are included in the City’s Capital Improvements Plan (Project Numbers: GB021, GC047 and GC053) at a not to exceed amount of $182,000.

 

IMPACT STATEMENT:

This resolution will support the completion of a multi-phase development that will add senior care facilities to Aurora and eventually, with the completion of Commons Drive, improve transit and traffic issues in the Route 59 Corridor area. 

 

RECOMMENDATIONS:

Staff recommends the proposed resolution be adopted.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, the potential extension of Commons Drive from Ogden Avenue to 75th Street will increase traffic capacity and will meet a requirement of the 2019 Redevelopment Agreement with Aurora Town Center Associates, LLC (R19-053); and

 

WHEREAS, the proposed improvements are included in the City’s Capital Improvements Plan (Project Numbers: GB021, GC047 and GC053); and

 

WHEREAS, HR Green, Inc. of 2363 Sequoia Drive, Suite 101, Aurora, IL 60506 was selected as the most qualified out of sixteen (16) firms submitting Statements of Qualifications; and

 

WHEREAS, account 225-4460-431.73-23 has sufficient funds for the portion of the project that will be completed this year; and

 

WHEREAS, additional funding has been requested in the 2021 budget to continue this project.

 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: that the award of a contract to HR Green, Inc. in the amount of $182,000 for design engineering services in accordance with Resolution R19-053 a Redevelopment Agreement with Aurora Town Center Associates for engineering design work associated with Phase I of the agreement is hereby approved, and the Director of Purchasing is hereby authorized to enter into such a contract on behalf of the City.
