SUBJECT:

A Resolution approving an Intergovernmental Agreement between the City of Aurora and Illinois Department of Transportation for partial reimbursement of the S. Broadway Ave Sewer Separation - Hazel Ave to North Ave project.

 

PURPOSE:

The City designed, bid, approved and constructed new storm sewers on S. Broadway Avenue (IL Rte 25) between Hazel Avenue and North Avenue in 2025 removing stormwater from the combined sewer system ahead of the street overlay of S. Broadway Avenue to be completed by IDOT's contractor in spring 2026.

 

BACKGROUND:

New storm sewers were installed to remove surface drainage flows from the combined sewer system.  The construction project with Performance, Construction and Engineering was approved by City Council as resolution R25-077 on March 11, 2025. There will be a future phase II project likely in 2026 extending this storm sewer along several adjacent east-west streets in City of Aurora R.O.W.  This project has helped to satisfy the requirements associated with the City's Long Term Control Plan and the City's Illinois Environmental Protection Agency Combined Sewer System Overflow Permit.

 

DISCUSSION:

IDOT has a defined storm sewer reimbursement policy detailed in section 5-5.02(d) of their Bureau of Design and Environmental manual. "Exhibit A" includes the initial reimbursement request from the City and the resulting Letter of Intent issued by IDOT acknowledged by the City.  The Letter of Intent accepts the City's request for reimbursement proposal amount of $725,736 which is approximately 31.2% of the storm sewer cost.  The reimbursement percentage is calculated based on a formula detailed in the manual which accounts for the percentage of IDOT R.O.W. drained by the proposed storm sewer.   A phase II for this storm sewer will include several laterals serving City of Aurora R.O.W.

 

The IGA attached as "Schedule A" has been reviewed and approved by the City's legal department.

 

The majority of the project was funded from account 281-1856-512-73-09 ($2,363,777.00, B031, LTCP Improvements - Sewer Separation) and the funds received from IDOT will be deposited back into the LTCP fund.  Approximately, one third of the project cost included replacing approximately 98 lead water services within this section of S. Broadway Avenue which would not be eligible for reimbursement.

 

IMPACT STATEMENT:

Acceptance of this IGA will replenish funds in the Long Term Control Plan fund allowing for additional sewer separation to be completed within the City.

 

RECOMMENDATIONS:

I request the proposed resolution be adopted.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, it was necessary and desirable to construct a separate storm sewer in Illinois Department of Transportation Right-of-Way along S. Broadway Avenue (Illinois Route 25) between Hazel Avenue and North Avenue; and

 

WHEREAS, the City designed, bid, approved and constructed new storm sewers on this section of S. Broadway Avenue (IL Rte 25) in 2025; and

 

WHEREAS, the Illinois Department of Transportation provided the IGA attached as "Schedule A" for approval and execution; and

 

WHEREAS, the Illinois Department of Transportation also provided the Letter of Intent attached as "Exhibit A" for reference.

 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: that the Intergovernmental Agreement between City of Aurora and Illinois Department of Transportation, attached hereto and incorporated herein, as "Schedule A" is hereby approved.

 

BE IT RESOLVED, that the Mayor and City Clerk are authorized to execute the Intergovernmental Agreement in “Schedule A” or any document that substantially and materially conforms to the provisions set forth in “Schedule A” on behalf of the City.
