SUBJECT:
A resolution authorizing the Mayor and City Clerk to execute a not-to-exceed contract in the amount of $30,000 with Geneva Construction Company for the 2014 Downtown Sidewalk Removal and Replacement Project.  
 
PURPOSE:
To obtain City Council approval to enter into a contract with Geneva Construction Company to repair sidewalk in the downtown area.
 
BACKGROUND:
This is an annual project intended to make repairs to sidewalk, curb and gutter and other concrete infrastructure.  The project is bid to establish unit prices so that we can maximize the work performed within the allotted budget.
 
DISCUSSION:
Bids were publicly opened and read on February 26 of this year.  Three bids were submitted (see attached Bid Tabulation) and Pueblo Concrete was the apparent low bidder.
Since the intent is to award a contract with a value in excess of $25,000, the ordinance requires that the responsible bidder pay prevailing wages and participate in an apprenticeship and training program approved by the U.S. Department of Labor.
 
Pueblo Concrete was issued a notice of violation by the Illinois Department of Labor in 2013 for a project they performed for the City of Aurora in 2012 for not paying prevailing wages.
 
In light of this, we recommend awarding the project to the 2nd low bidder, Geneva Construction Company.  Geneva Construction's bid was just below the Engineer's Estimate.
 
The 2014 budget has $30,000 set aside in account # 231-4430-418.38-18 for this project.
 
IMPACT STATEMENT:
This project should have no negative impact.
 
RECOMMENDATIONS:
We respectfully request that you forward this agreement to the Finance Committee for their review and favorable recommendation.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
 
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
 
WHEREAS, bids were received and publicly opened and read on February 26th, 2014; and
 
WHEREAS, Geneva Construction Company of Aurora, IL was deemed the lowest responsible bidder; and
 
WHEREAS, the 2014 City Budget provides $30,000 for this project in account #231-4430-418.38-18.
 
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: that the Mayor and City Clerk be and are hereby authorized to enter into a contract with Geneva Construction Company, P.O. Box 998, Aurora, IL 60507 for the unit prices show within the bid, not to exceed $30,000.
