SUBJECT:

A Resolution authorizing the Director of Purchasing to enter into a three year agreement with Semper Fi Yard Services Inc. for the Landscape Maintenance of East Side Rain Gardens in the amount of $80,178.00 per year.

 

PURPOSE:

To enter into a three year agreement for the landscape maintenance of the east side rain gardens located within the combined sewer system on the City's near east side.  See Exhibit A for a map of locations covered under this contract.

 

BACKGROUND:

On June 26, 2012 the City of Aurora entered into a financial assistance agreement with the Illinois Environmental Protection Agency for the construction of rain gardens within the City's combined sewer system, through the Illinois Green Infrastructure Grant Program.  The construction of the rain gardens is a required part of the EPA mandated Combined Sewer Overflow Long Term Control Plan.  The financial assistance agreement requires the City to adequately maintain the rain gardens.

 

DISCUSSION:

On February 24, 2016 the City Clerk received three bids for the above referenced contract.  Semper Fi Yard Services, Inc. was the lowest responsible bidder for a total not to exceed bid amount of $80,178.00,

 

Funding for this work is included in the 2016 Budget within the Stormwater Fee Fund, CIP NO. B049, "Stormwater Management Facility Maintenance/Improvement" Account number 280-1852-512-81-90.  This Contract is for three years; if the work performed is satisfactory and it is agreed to by both parties, this Contract may be extended annually a maximum of two times for a total Contract length of up to five years.  The value of each year of the Contract will be $80,178.00. 

 

IMPACT STATEMENT:

These rain gardens are a required component of the City's EPA mandated Combined Sewer Overflow Long Term Control Plan.  In order to ensure that the rain gardens function as designed, the gardens must be properly maintained.

 

RECOMMENDATIONS:

I request the proposed resolution be adopted.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, on February 26, 2016 the City Clerk received three proposals for the above reference work.  Semper Fi Yard Services Inc. was the low, responsive, responsible bidder in the amount not to exceed Eighty Thousand, One Hundred Seventy-Eight Dollars and No Cents ($80,178.00).  See bid tabulation contained herein as Exhibit "B"; and

 

WHEREAS, the 2016 budget provides funding for this work in CIP project number B049, account No. 280-1852-512-81-90, (Stormwater Fee Fund); and

 

WHEREAS, the Contract is for three years of service; should the work performed be considered satisfactory by the City for the first three years, and it is mutually agreed to by both parties, this Contract may be extended annually a maximum of two times for a total Contract length of up to five years; and

 

WHEREAS, the Contract amount per year is a not to exceed amount of $80,178.00.

 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: the Director of Purchasing is hereby authorized to enter into a three year agreement with Semper Fi Yard Services Inc. for the Landscape Maintenance of the East Side Rain Gardens in the amount of $80,178.00.
