A Resolution Approving a Revision to the Final Plan on Lot 12 of McCarty Center Subdivision for a Dunkin Donuts with a drive-thru located at 3999 75th Street, Aurora, IL, 60504 (Raj Patel- L15-00002 / NA28/3-14.283-Fpn/R - ES - Ward 8)   
 
PURPOSE:
Raj Patel has purchased the subject property plans to operate a Dunkin Donuts out of half of the building. The other half will be used as an Office.  Approval of the Final Plan Revision will allow for minor revisions to the building and site including converting the former bank drive-thru to a restaurant drive thru.   
 
BACKGROUND:
The subject property is located at the southwest corner of 75th Street and Commons Drive and is part of the master planned McCarty Center Subdivision.  The majority of the development consists of office condos while this lot was constructed as a drive-thru bank in 2007.  The property is zoned B-2(S), and is surrounded by the office condos to the west, townhomes to the south, vacant B-2(S) property to the north, and vacant unincorporated property to the east.  
 
DISCUSSION:
The petitioner is proposing to modify an existing bank building into a Dunkin Donuts restaurant for half of the building, and the other half will be an office use.  The existing bank drive-thru will be slightly modified to accommodate the new use.  This 4,875 square foot bank building was has been vacant for a few years.  All parking and landscaping is in place, and five additional parking spaces will be added where the former bank drive-thru lanes were.  A small amount of new curbing will be added with foundation plantings for the modified drive-thru.  This plan will allow for a re-use of a vacant building and help with the economic vitality of the area and provide a service of a new restaurant.  Parking is sufficient for the new use, and all utilities and good access is in place.  
 
POLICIES AND GUIDELINES:
30.0      To promote and plan for the location of commercial centers, based on their functions and interrelationships, in order to provide a balanced distribution of commercial development and redevelopment.
31.1(3)  To promote the development of commercial facilities in existing or planned commercial areas.   
 
RECOMMENDATIONS:
Planning Commission recommended APPROVAL of the Resolution Approving a Revision to the Final Plan on Lot 12 of McCarty Center Subdivision for a Dunkin Donuts with a drive-thru located at 3999 75th Street, Aurora, IL, 60504.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
 
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
 
WHEREAS by petition dated December 30, 2014,  filed with the City of Aurora a petition requesting approval of a Final Plan Revision for McCarty Center Subdivision  Lot 12 and related required documents as attached hereto as Exhibits "A-1" through Exhibit "A-4"; and
 
WHEREAS, on February 4, 2015, the Aurora Planning Commission reviewed said Final Plan Revision and recommended APPROVAL of said petition; and
 
WHEREAS, on February 12, 2015, the Planning and Development Committee of the Aurora City Council reviewed said Final Plan Revision and before mentioned recommendations and recommended CONDITIONAL APPROVAL of said petition; and   
 
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Aurora, Illinois, finds as facts all of the preamble recitals of this Resolution and hereby grants APPROVAL of said Final Plan Revision with the following conditions:
 
1. That any new or existing landscaping installed that should die or has died be replaced prior to the next planting season.
 
2. That the building elevation reflect the existing cover over the drive thru.
 
BE IT FURTHER RESOLVED that the City Council of the City of Aurora hereby adopts the Final Plan Revision and related required documents as attached hereto as Exhibit "A-1" Final Plan, Exhibit "A-2" Landscape Plan, Exhibit "A-3" Building and Signage Elevations, Exhibit "A-4" Fire Plan along with any dedications deemed necessary by the Aurora City Engineer.
