SUBJECT:

A Resolution Approving a Revision to the Final Plan on Lot 1 - Outlot 3 of Aurora Market Subdivision for a Restaurant with a drive-through facility (2530) use located at 491 S. State Route 59 being south of Ogden Avenue and west of Route 59  (Panera, LLC - 16-00935 / NA28/2-16.054-Fpn/R - AM - Ward 10)  

 

PURPOSE:

The Petitioner, Panera, LLC is requesting approval of a Final Plan Revision for a 4,323 sq. ft. Restaurant with a drive-through facility at 491 S. State Route 59.  

 

BACKGROUND:

The Subject Property is located south of Ogden Avenue and west of Route 59 with PDD zoning as part of the Fox Valley East Planned Development District. The Subject Property is located along the State Route 59 commercial corridor and is a now vacant building, previously occupied by First Midwest Bank. Additional information on the legislative history of the property can be found in the attached Property Information Sheet. 

 

The details of the Final Plan Revision include the demolition the existing building and construction of a new 4,323 square foot Panera Bread restaurant with a drive thru. The footprint building will be moved a little to the south, 15 parking spaces will be added along the north side of the building and a drive thru facility will be installed along the south of the building. Access to the site will be from the internal drive isle for the development from Route 59; there are existing overflow parking spaces to serve the restaurant west of the internal drive isle. There is a new 8 foot monument sign proposed at the southwest corner of the property visible from State Route 59. Directional signage and a menu board are also being proposed.

 

The Final Plan proposal includes a Landscape Plan and Building Elevations for the proposed restaurant.  The façade of the building is a mixture of red brick veneer, ivory and green accent limestones, dark bronze aluminum and custom pattern vinyl awnings.      

 

DISCUSSION:

Staff has reviewed the Final Plan Revision petition and have sent comments back to the petitioner on those submittals.  The petitioner has made the requested revisions to these documents and they now meet the applicable codes and ordinances. 

 

POLICIES AND GUIDELINES:

The Staff’s Evaluation and Recommendation are based on the following Physical Development Policies:

11.1(5)  To guide and promote development to areas where public utilities, public roads and municipal services are either available or planned.

31.1 (1)  To promote the concept of a hierarchy of commercial development consisting of regional, community and neighborhood commercial centers supported by requisite population levels, which influence to location, scale and type of commercial development and redevelopment.

32.1 (4)  To enhance the quality of the visual and physical environment of the City through the provision for landscaping in commercial development.

51.1 (6)  To promote the location and expansion of commercial activities within the City consistent with the Comprehensive Plan.   

 

RECOMMENDATIONS:

The Planning Commission recommended APPROVAL of the Resolution Approving a Revision to the Final Plan on Lot 1 - Outlot 3 of Aurora Market Subdivision for a Restaurant with a drive-through facility (2530) Use located at 491 S. State Route 59 being south of Ogden Avenue and west of Route 59.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS,  by petition dated September 19, 2016, Panera, LLC filed with the City of Aurora a petition requesting approval of a Final Plan Revision for 491 S. State Route 59 for a Restaurant with a drive-through facility (2530) Use and related required documents as attached hereto as Exhibits "A-1" through Exhibit “A-3”; and

 

WHEREAS, after referral of said petition from the Aurora City Council, the Aurora Planning Commission on November 2, 2016, reviewed the petition and recommended APPROVAL of said petition; and

 

WHEREAS, on November 14, the Planning and Development Committee of the Aurora City Council reviewed said Final Plan Revision and the before mentioned recommendations and recommended APPROVAL of said petition; and 

 

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Aurora, Illinois, finds as facts all of the preamble recitals of this Resolution and hereby grants APPROVAL of said Final Plan Revision.

 

BE IT FURTHER RESOLVED that the City Council of the City of Aurora hereby adopts the Final Plan Revision and related required documents, as attached hereto as Exhibit "A-1" Final Plan, Exhibit “A-2” Landscape Plan, and Exhibit “A-3” Building and Signage Elevations, along with any dedications or modifications deemed necessary by the Aurora City Engineer.
