SUBJECT:

Resolution Authorizing the Execution of an Agreement between the City of Aurora and the Fox Valley Park District Concerning the Staging of Fireworks on Park District Property on July 4, 2025 and July 4, 2026.

 

PURPOSE:

Execution of an Agreement with the Fox Valley Park District for the staging of the 4th of July fireworks in 2025 and 2026.

 

BACKGROUND:

The City of Aurora has been hosting the 4th of July activities on Fox Valley Park District property since the opening of RiverEdge Park in 2013. We are looking to continue that relationship with a two-year Intergovernmental Agreement.

 

DISCUSSION:

McCullough Park will provide the venue for entertainment, vendors, amenities and fireworks viewing.  Veterans Island will be utilized for the launch site.  The attached Intergovernmental Agreement formalizes what has been past practices and shows a renewed spirit of cooperation with the Fox Valley Park District.  

The City will take care of all logistics and programming and has discussed the needs with the FVPD to make sure all details are covered.

 

The FVPD Board, staff and Legal Counsel have reviewed and approved the attached IGA as well as the City's Corporation Counsel.

 

 

IMPACT STATEMENT:

This Agreement will allow the City and Park District to work together on the staging of fireworks for the City's July 3rd Fireworks Celebration.

 

The City services impact for this event will be covered through Eproval with all affected Departments and Divisions.

 

RECOMMENDATIONS:

I request the attached resolution be reviewed by the Finance Committee and sent on to City Council for final approval.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, Section 10 of Article VII of the Constitution of this State authorizes units of local government and school districts to contract or otherwise associate among themselves, with the State, with other states and their units of local government

and school districts, and with the United States to obtain or share services and to exercise, combine, or transfer any power or function, in any manner not prohibited by law or by ordinance; and

 

WHEREAS, City and Fox Valley Park District (Park District) are units of local government organized and existing under the laws of the State of Illinois, having among their powers the authority to contract with one another to perform the undertaking described herein and as specifically authorized by the Intergovernmental Cooperation Act; and 

 

WHEREAS, the City and the Park District have agreed to the terms set forth in the attached Agreement, which provides for the use Park District property for the staging of the fireworks display for City's Independence Day celebration on July 3, 2025 and July 3, 2026 ; and

 

 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: that the attached intergovernmental agreement shall be and hereby is approved; and further

 

BE IT RESOLVED, that Mayor and City Clerk shall be and hereby are authorized and directed to execute said agreement on behalf of the City and transmit a copy thereof to the Park District forthwith.
