A Resolution for Acceptance of Improvements and Maintenance Security for Advocate / Dreyer Medical Center - 2285 Sequoia Dr. and the release of the $500,000 additional security associated with the applicant's former property located at 1870 West Galena Blvd., Aurora, IL. 60506 - 13.519
PURPOSE:
To accept the Public Improvements and Maintenance Security for Advocate / Dreyer Medical Center - 2285 Sequoia Dr and release the $500,000 additional security associated with the applicant's former property located at 1870 West Galena Blvd., Aurora, IL. 60506.
BACKGROUND:
This development has completed all installations, inspections and submissions of the public improvements that make it eligible to be recommended for final acceptance of those improvements, including requirements associated with a "Building Permit Fee Rebate Agreement". The requirements of the agreement required the posting of an additional $500,000.00 to this project's security as a guarantee of City approved disposition of the applicant's former property located at 1870 West Galena Blvd., Aurora, IL. 60506.The sale of the former property by the developer, to the West Aurora School District for redevelopment has acted to satisfy the property's disposition with the City and allows the release of said $500,000.00 additional security.
DISCUSSION:
The Subdivision Control Ordinance, upon the acceptance of the improvements by City Council, requires the posting of a security for a one year maintenance period.
IMPACT STATEMENT:
This action may add new public infrastructure /utilities to various divisions for maintenance, including streets, water, storm, sanitary, electrical, storm water management, fiber optic.
RECOMMENDATIONS:
Approve the acceptance of Improvements and Maintenance Security for Advocate / Dreyer Medical Center - 2285 Sequoia Dr and the release of the $500,000 additional security associated with the applicant's former property located at 1870 West Galena Blvd., Aurora, IL. 60506.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS, Advocate Health Care, has completed the public improvements and requirements associated with a "Building Permit Fee Rebate Agreement" for said project; and
WHEREAS, these said improvements have been inspected during construction by the Engineering Department, or their authorized representative, and were found to be in substantial conformance with the approved plans; and
WHEREAS, Advocate Health Care was required to post an additional $500,000.00 to this project's security as a guarantee of City approved disposition of the applicant's former property located at 1870 West Galena Blvd., Aurora, IL. 60506; and
WHEREAS, the sale of the former property to the West Aurora School District has satisfied that requirement, and therefore the release of the $500,000.00 in additional security is now warranted; and
WHEREAS, the City Engineer has recommended acceptance of the improvements upon posting of a Maintenance Security in the amount of $182,684.00
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: that the improvements shall be accepted upon receipt of Maintenance Security in the amount of $182,684.00, and be it further resolved, the $500,000.00 security for the project is hereby released..
