SUBJECT:

A Resolution approving a Preliminary Plan for Butterfield Phase II Unit 4C being vacant land located south of Ferry Road between Frieder Lane and Meridian Road (Old Dominion Freight Line, Inc. - 15-01145 / NA04/1-15.226-Ppn/Psd/R - AM - Ward 10)  

 

PURPOSE:

The Petitioner, Old Dominion Freight Line, Inc., is requesting approval of a Preliminary Plan on Lot 402 of Butterfield Phase II Unit 4C located at the southeast corner of Ferry Road and Meridian Road for a Motor Truck Terminal (3310) which includes a newly constructed 53,200 square foot facility and required stormwater detention on a 17.64 acre lot.   

 

BACKGROUND:

The Subject Property is located south of Ferry Road between Frieder Lane and Meridian Road.  The majority of the property (12.65 acres) was previously annexed and rezoned under the Butterfield Planned Development District, the remaining acres is being proposed to be annexed and rezoned under the same planned development concurrently with this petition.  Additional information on the legislative history of the property can be found in the attached Property Information Sheet. 

 

The details of the proposal include the construction of a new 53,200 square foot motor truck terminal, the extension of City water lines, extension of sewer service from the existing Lift Station, roadway improvements for Meridian Road and Sunrise Road and a stormwater detention pond.  

 

Concurrently with this proposal, the Petitioner is proposing a Preliminary Plat revision of Butterfield Phase II Unit 4C and an Annexation Agreement and Annexation of 4.96 acres of the Subject Property.   

 

DISCUSSION:

Staff has reviewed the Preliminary Plan petition and have sent comments back to the petitioner on those submittals, with the exception of the items mentioned in the Staff Recommendation listed below.   

 

POLICIES AND GUIDELINES:

The Staff’s Evaluation and Recommendation are based on the following Physical Development Policies:

11.1                     (5)                     To guide and promote development to areas where public utilities, public roads and municipal services are either available or planned.

12.0                                          To plan and provide for the growth of the city through the integration of land use patterns and functions that promotes complementary interactions between different land use components.

31.1                     (3)                     To promote the development of commercial facilities in existing or planned commercial areas.

  

 

 

 

RECOMMENDATIONS:

The Planning Commission recommends DENIAL of the Resolution approving a preliminary plan for Butterfield Phase II Unit 4C being vacant land located at the north west corner of Sunrise Road and Meridian Road.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, by petition dated December 30, 2015, Old Dominion Freight Line, Inc. filed with the City of Aurora a petition requesting approval of a Preliminary Plan on Lot 402 of Butterfield Phase II Unit 4C located at the southeast corner of Ferry Road and Meridian Road for a Motor Truck Terminal (3310) and related required documents as attached hereto as Exhibits "A"; and

 

WHEREAS, after referral of said petition from the Aurora City Council, the Aurora Planning Commission on May 18, 2016, reviewed the petition and recommended DENIAL of said petition; and

 

WHEREAS, on May 26, 2016 the Planning and Development Committee of the Aurora City Council reviewed said Preliminary Plan and the before mentioned recommendations and recommended CONDITIONAL APPROVAL of said petition; and  

 

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Aurora, Illinois, finds as fact all of the preamble recitals of this Resolution and hereby grants ___________________________of said Preliminary Plan with the following conditions:

 

ADD CONDITIONS

 

BE IT FURTHER RESOLVED that the City Council of the City of Aurora hereby adopts the Preliminary Plan and Plat and related required documents as attached hereto as Exhibit "A" Preliminary Plan.
