Appointment of Liquor Control Hearing Officer.
PURPOSE:
To fulfill the purpose of Article II in Chapter 6 providing for the appointment of up to two Liquor Control Hearing Officers.
BACKGROUND:
The City has ongoing need for hearings to determine culpability in liquor cases, and the Council added Article II to Chapter 6 for the purpose of adding objective outside attorneys as hearing officers to assist in this endeavor.
DISCUSSION:
James G. Wargo is a former partner in the law firm of Klein, Thorpe and Jenkins who now has his own practice with offices in Geneva and Huntley, Illinois. Jim is a contributing author of the "Manual on Liquor Licensing and Regulation" published by the Illinois Municipal League in 2011, among other legal writings. Jim has also served as a Prosecutor and Assistant Village Attorney in addition to his general representation of municipalities in his work for Klein, Thorpe and Jenkins. Jim comes highly recommended by Lance Malina of Klein, Thorpe.
IMPACT STATEMENT:
This position is paid $75 for hearings lasting less than 90 minutes, and $150 for hearings lasting longer than 90 minutes.
RECOMMENDATIONS:
That James G. Wargo be appointed as a Liquor Control Hearing Officer.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS, Chapter 6, Article II of the Aurora Code of Ordinances calls for the appointment by the Liquor Commissioner with the advice and consent of the City Council of up to two Liquor Control Hearing Officers; and
WHEREAS, it is the Liquor Commissioner's desire that James G. Wargo, attorney at law, be appointed to the position of Liquor Control Hearing Officer for the City of Aurora.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Aurora, Illinois, does hereby approve the appointment of James G. Wargo, attorney at law with offices in Geneva, Illinois and Huntley, Illinois as a Liquor Control Hearing Officer, effective October 29, 2014.
