SUBJECT:
To request authorization to execute a Redevelopment Agreement with Aurora Curbside Limited in the amount of $50,000 for the purpose of installing a freezer and electrical upgrades to the property at 260 South Highland once Aurora Curbside Limited acquires and occupies the property.  
 
PURPOSE:
The City of Aurora will be purchasing the current property of Aurora Curbside Limited, the ice cream vender facility at 143 Middle Avenue. Aurora Curbside Limited will be acquiring and relocating the business to 260 South Highland Avenue. The 260 South Highland property is in need of electrical upgrades, in part to house a new freezer to replace the one at 143 Middle Avenue, which was found to be difficult to remove. The redevelopment agreement would allow for the City to grant Curbside Limited the funds necessary to buy and install the freezer, and to perform electrical upgrades to the building.)
 
BACKGROUND:
Both the City and Seize the Future Development Foundation have been working to acquire the Middle Avenue property to complete the build-out of the parking lot along Lake Street. The opportunity to both acquire this property and for Curbside Limited to have found a suitable location to move their business prompted the action taken by the City, and the ability to provide an incentive to make improvements to the new property to accept the necessary infrastructure for the business.
 
DISCUSSION:
There is a clawback provision in the agreement that necessitates Aurora Curbside Limited staying in business at this location for three years. Also, the incentive is effective once the Highland Property is acquired. Funding for this agreement is available from Account Number  215-1710-417.71-01 (Cost of Land)
 
 
IMPACT STATEMENT:
Approving this redevelopment agreement completes the City's plan for 143 Middle Avenue once acquired, and the new home of Aurora Curbside Limited will maintain jobs for the community..
 
RECOMMENDATIONS:
Staff recommends approval of the Redevelopment Agreement attached as Exhibit "A" in the amount of $50,000.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
 
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
 
WHEREAS, The City of Aurora is desirous to acquire the property at 143 Middle Avenue, currently home to Aurora Curbside Limited, for future development purposes; and
 
WHEREAS, Aurora Curbside Limited is desirous to acquire the property at 260 South Highland as the location in which to relocate their business; and
 
WHEREAS, it is necessary and desirable to enter into a redevelopment agreement for this purpose, and therefore attached hereto as Exhibit "A"  is a Redevelopment Agreement authorizing  Fifty Thousand Dollars ($50,000) for the purpose of providing upgrades to the property at 260 South Highland Avenue, once the property is acquired by Aurora Curbside Limited; and
 
WHEREAS, funding for this request is available in Account Number 215-1710-417.71-01 (Cost of Land).)
 
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows:
 
Section 1:      The Preambles hereto are hereby made a part of, and operative provisions of, this Resolution as fully as if completely repeated at length herein.
 
Section2:       That the Mayor and City Council of the City of Aurora hereby find that it is in the best interests of the City of Aurora and its residents that the aforesaid "Redevelopment Agreement" with Aurora Curbside Limited, be entered into by the City of Aurora, with said Agreement to be substantially in the form attached hereto and made a part thereof as Exhibit "A".
 
Section 3:      That the Mayor and City Clerk of the City of Aurora, Kane, Kendall, Will and DuPage Counties, Illinois, are hereby authorized to execute for and on behalf of the City of Aurora, the aforesaid Redevelopment Agreement.
