An Ordinance Amending Chapter 32 of the City of Aurora Code of Ordinances titled "Peddlers and Solicitors".

 

PURPOSE:

The purpose of this memo is to propose changes to Chapter 32 of the City of Aurora's Code of Ordinances for for-profit peddlers and solicitors only, specifically the fee charged the peddlers for the permit and to eliminate the need for non-profit peddlers to obtain a city photo-identification.

 

BACKGROUND:

Chapter 32 of the City of Aurora's Code of Ordinances is dedicated to the rules and regulations relating to peddlers and solicitors in the City of Aurora. In 2015, changes were made to the ordinance to include an application fee, issuing badges, increasing the information requested of peddlers on applications, setting time limits on permits, and adding provisions to the ordinance regarding acceptable practices of peddlers. A fee of $50.00 for ninety days was adopted to the ordinance at that time.

 

DISCUSSION:

It has been three years since the peddler fee was initiated by the City of Aurora. While the number of peddlers has decreased, the amount of preparation for the badges and oversight of the program has increased. A survey of neighboring and comparable municipalities shows a variety of fee structures from a daily to annual fee. To compare those reviewed across structures the daily fee range was calculated to be from $.08 per day to $25.

The City of Aurora currently charges $.56 per day. While the number of peddlers has decreased since the changes were made in 2015, the cost of implementing and oversight of the permit process has increased. It is being recommended to increase the fee for the peddler to be increased from $50 for 90 days to $100 for 30 days. The increase would be in line with the trend of other municipalities in raising their rates. Also, by raising the investment cost of peddling within the City it will encourage greater compliance with the rules and regulations previously established by the City. Charitable Solicitors would remain at no charge. 

 

The other change being recommended is to cure the inconsistency between the requirements for charitable solicitors needing a copy of a permit (Sec. 32-3(b)) versus a photo identification badge (Sec. 32-39) on their person. To create consistency it is recommended that all charitable solicitors be required to have a copy of the permit on their person at all times. There are situations, e.g. Girl or Boy Scout Troops, where having a photo permit for each child would not be appropriate or would be cost prohibitive to produce. 

 

IMPACT STATEMENT:

The proposed changes, if implemented, are expected to have a positive impact on our neighborhoods by encouraging greater compliance with the peddler ordinance. 

 

 

RECOMMENDATIONS:

 I request that this Ordinance be forwarded to the Committee of the Whole on September 4, 2018 for further consideration.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, the City deems it necessary and appropriate to amend the provisions regarding for-profit peddlers and solicitors.

 

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Aurora, Illinois, as follows: that Chapter 32 of the City of Aurora Code of Ordinances be amended per the changes in Exhibit A.
