SUBJECT:

A resolution authorizing the Director of Purchasing to enter into an agreement with M/M Peters Construction, Aurora, IL in the amount of $103,00.00 for repairs to the vault at 69 E. Downer Place.

 

PURPOSE:

To enter into an agreement with M/M Peters Construction in the amount of $103,000 for repairs to the vault at 69 E. Downer Place.

 

BACKGROUND:

Throughout the central business district of downtown Aurora, the basements of various properties extend beyond the property line under the sidewalk into the public Right-of-Way (ROW). 

 

These areas, known as sidewalk vaults, were previously functional spaces that are no longer required; though they are no longer required, many still exist to this day.  These vaults are only accessible for private use but are located under City property designated for public use (generally the adjacent sidewalk).  As such, for many years the City has had cost sharing program with the adjacent property owner to fill the vaults prior to, or in response to, any issues associated with the vault. 

 

The City has a limited annual budget for vault filling; to qualify for the program the property owner must vacate the vault and remove any private equipment.  For any vaults in this condition, the City will prioritize the vault filling projects and when budget permits complete the process required to design and execute the filling of each vault.

 

 

DISCUSSION:

The first stage of the vault filling approval process is an evaluation of the existing vault condition.  This requires an analysis of any work required by the property owner to be eligible for the program; additionally it is a structural assessment to determine the extent of improvements required to safely backfill the vault. When conducting this assessment at 69 E. Downer Place, it was determined that immediate action was required to avoid potential deterioration of the structural system that is integral to both the sidewalk and the adjacent building. 

 

In order to expedite the repair of the vault, the City hired a structural engineer to develop a scope for improvements and solicited quotes from five contractors to complete the repairs and fill the vault.  Of the five contractors contacted, three replied with repair bids.  Of those three bids received on 4/19/22, the low bid was from M/M Peters.  The bid tabulation is attached and in addition a contingency of approximately 10% has been added for a total recommended award price of $103,000.

 

Local Preference was included for this contract, but did not impact the decision. 

 

The project will be funded using a combination of risk funds and from account 231-1830-465.38-18.

 

IMPACT STATEMENT:

Repairs to this vault will reinstate usage of the sidewalk that is currently closed due to the need for these improvements. 

 

RECOMMENDATIONS:

I request the proposed resolution be adopted.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, When conducting this assessment at 69 E. Downer Place, it was determined that immediate action was required to avoid potential deterioration of the structural system that is integral to both the sidewalk and the adjacent building; and

 

WHEREAS, Three quotes for the repairs to the vault at 69 E. Downer Place were received; and

 

WHEREAS, M/M Peters Construction, Aurora, IL provided the lowest responsible bid in the amount of the low bidder in the amount of $94,344.30; and

 

WHERAS, an additional contingency has been added to bring the total award amount to $103,000; and

 

WHEREAS, funding will be provided from risk funds and account 231-1830-465.38-18; and

 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: authorizing the Director of Purchasing to enter into an agreement with M/M Peters Construction, Aurora, IL in the amount of $103,000 for repairs to the vault at 69 E. Downer Place.
