SUBJECT:
Resolution Authorizing Execution of Supplemental Motor Fuel Tax Resolutions for Sections 13-00000-00-GM and 14-00-00000-00-GM.  
 
PURPOSE:
To appropriate additional Motor Fuel Tax (MFT) Funds related to snow removal operations for FYs 2013 and 2014.
 
BACKGROUND:
The City of Aurora appropriated MFT funds in the amount of $720,440 and $941,750 for FY 2013 and FY 2014 respectively.  In 2013 the Street Division spent a total of $1,047,762.80 creating an appropriation shortfall of $327,322.75.  In 2014 the Street Division spent a total of $1,320,313.40 on snow removal operations, also creating an appropriation shortfall in the amount of $378,563.35.
 
DISCUSSION:
In accordance with the Illinois Department of Transportation's Bureau of Local Roads and Streets, the Local Public Agency is required to adopt a Supplemental Resolution if the actual cost of maintenance exceeds the total amount of MFT funds appropriated
 
IMPACT STATEMENT:
There will be no negative impact associated with these appropriations as these projects are completed and no additional funds will be spent.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
 
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
 
WHEREAS, in accordance with the Illinois Department of Transportation, Bureau of Local Roads and Streets Policy and Procedures; and
 
WHEREAS, said Policy and Procedures require that the Local Agency adopt a Supplemental Resolution authorizing additional Motor Fuel Tax Funds for those projects whose total cost exceeds the initial MFT appropriation; and
 
WHEREAS, Snow Removal Operations in FY 2013 exceeded appropriated MFT funds in the amount of $327,322.75 and in FY 2014 Snow Removal Operations exceeded appropriated MFT funds in the amount of $378,563.35; and
 
WHEREAS, the City of Aurora desires to appropriate additional Motor Fuel Tax funds for MFT Sections 13-00000-00-GM and 14-00000-00-GM for completed snow removal operations in FYs 2013 and 2014; and
 
WHEREAS, by signing the Supplemental MFT Resolutions, attached hereto as Exhibit 1, the City of Aurora is not authorizing additional funds to be expended in conjunction with this resolution.
 
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: that the City of Aurora does hereby approve the execution of the Supplemental MFT Resolutions as attached hereto as Exhibit 1.
