SUBJECT:

A Resolution Accepting the Dedication of a Stormwater Easement on certain portions of Farnswood Condominium No. 1, No. 2, and No.3 at 1545 Perry Court (Farnswood Condo Association - L16-00058 / AU12/3-15.193-DED/E - AM - Ward 1)  

 

PURPOSE:

The City of Aurora, Engineering Division, is working with the Farnswood Condo Association on proposed drainage improvements to provide flooding relief in the low lying area with the Farnswood Subdivision and improve storm sewer conveyance along Reckinger Road.  

 

BACKGROUND:

The Subject Property is located at 1545 Perry Court within the Farnswood Condominium Association with R-5(S) zoning. The property is generally located east of Farnsworth Avenue and McClure Road, north of Reckinger Road.   

 

 

DISCUSSION:

Staff has reviewed the Dedication of Easement petition, submitted by the petitioner and have sent comments back to them on those submittals.  The petitioner has made all the requested changes to these documents and they now meet all of the applicable codes and ordinances.

 

IMPACT STATEMENT:

The Planning and Zoning Division would anticipate that this project will increase the City’s overall tax base and viability by facilitating investment and development which will offset any incidental Department or staffing impacts; enhancing the city’s infrastructure and improving services to its residence.

 

RECOMMENDATIONS:

 Staff would recommend APPROVAL of a dedication of a stormwater easement on certain portions of Farnswood Condominium No. 1, No. 2, and No.3

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, Farnswood Condominium Association, by petition dated January 21, 2016, filed with the City of Aurora, is requesting approval of a Dedication of Easement on certain portions of Farnswood Condominium No. 1, 2 and 3 at 1545 Perry Court as shown on the attached Exhibit "A" Plat of Easement; and

 

WHEREAS, on February 11, 2016 the Planning and Development Committee of the Aurora City Council reviewed said Dedication of Easement and recommended APPROVAL of said petition. 

 

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Aurora, Illinois, finds as facts all of the preamble recitals of this Resolution and hereby grants APPROVAL of said Dedication of Stormwater Easement .
