A Resolution Approving an Intergovernmental Agreement Between the City of Aurora and the Kendall County Cooperative Police Assistance Team (KCPAT).

 

PURPOSE:

The purpose of this Resolution is to seek City Council approval of an Intergovernmental Agreement (IGA) that allows the Aurora Police Department to continue its participation in the Kendall County Cooperative Police Assistance Team (KCPAT).

 

BACKGROUND:

On January 9, 2025, the Chief of Police executed an Intergovernmental Agreement permitting members of the Aurora Police Department to participate in the Kendall County Cooperative Police Assistance Team (KCPAT). KCPAT is a multi-agency law enforcement collaboration that includes the Illinois State Police, Oswego Police Department, Yorkville Police Department, Kendall County Sheriff’s Office, the Aurora Police Department, and the Kendall County State’s Attorney’s Office.

 

At the time of execution, the Chief of Police was authorized to enter into the agreement because it included a thirty (30) day termination provision. The is a no-cost agreement and is governed by the Illinois Intergovernmental Cooperation Act (5 ILCS 220/1).

 

DISCUSSION:

KCPAT requires participating agencies to renew the Intergovernmental Agreement on an annual basis, with execution by the Chief Law Enforcement Executive of each participating agency.

 

For the current renewal period, KCPAT issued an updated Intergovernmental Agreement, which is attached to this Resolution (Exhibit A). Upon review, it was determined that the termination provision had been revised from a thirty (30) day termination clause to a ninety (90) day termination clause (Section XII(A)).

 

Aurora Code of Ordinances, Section 2-287(d), requires that any agreement entered into under this section be cancelable upon no more than thirty (30) days’ notice. Due to the revised termination provision, the Chief of Police no longer has independent authority to execute the agreement without City Council approval.

 

KCPAT has advised that it will not revise the standard Intergovernmental Agreement applicable to all participating agencies. However, KCPAT has provided an amendment in the form of a “Side Letter Agreement,” which is also attached to this Resolution (Exhibit B). The Side Letter Agreement modifies the termination provision as it applies to the Aurora Police Department, restoring a thirty (30) day termination clause in compliance with City ordinance. Execution of the Side Letter Agreement is contingent upon City Council approval of the underlying Intergovernmental Agreement.

 

IMPACT STATEMENT:

Approval of this Resolution will allow the Aurora Police Department to maintain its participation in KCPAT and continue cooperative law enforcement efforts within Kendall County.

 

RECOMMENDATIONS:

Staff recommends approval of the Resolution authorizing the Chief of Police to execute the Intergovernmental Agreement with the Kendall County Cooperative Police Assistance Team (KCPAT), including the associated Side Letter Agreement.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, the City of Aurora, through its Police Department, participates in cooperative law enforcement initiatives with other agencies to enhance public safety and the effective delivery of police services; and

 

WHEREAS, the Kendall County Cooperative Police Assistance Team (KCPAT) is a multi-agency law enforcement collaboration that includes participation from municipal, county, and state law enforcement agencies, as well as the Kendall County State’s Attorney’s Office; and

 

WHEREAS, the Aurora Police Department has previously participated in KCPAT pursuant to an Intergovernmental Agreement entered into in accordance with the Illinois Intergovernmental Cooperation Act (5 ILCS 220/1); and

 

WHEREAS, KCPAT requires participating agencies to renew the Intergovernmental Agreement on an annual basis; and

 

WHEREAS, the most recent version of the Intergovernmental Agreement includes a ninety (90) day termination provision, which exceeds the maximum termination period authorized under Section 2-287(d) of the Aurora Code of Ordinances; and

 

WHEREAS, KCPAT has provided an amendment in the form of a Side Letter Agreement that modifies the termination provision as it applies to the City of Aurora, restoring a thirty (30) day termination provision consistent with City ordinance; and

WHEREAS, City Council approval is required in order to authorize execution of the Intergovernmental Agreement and associated Side Letter Agreement;

 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: The Intergovernmental Agreement between the City of Aurora and the Kendall County Cooperative Police Assistance Team (KCPAT), together with the associated Side Letter Agreement, attached hereto and incorporated herein as Exhibits A and B, is hereby approved.

 

BE IT RESOLVED, the Chief of Police is authorized to execute the Intergovernmental Agreement and Side Letter Agreement, or documents that substantially and materially conform to the provisions set forth in Exhibits A and B, on behalf of the City of Aurora.
