SUBJECT:
A Resolution Authorizing the Execution of a City Watermain Easement Agreement for the Redwood Watermain Project on the property located at 1851 W. Galena Boulevard (Fifth Third Bank - L15-00296 / AU19/2-15.095-DED/E - AM - Ward 5)   
 
PURPOSE:
At the City's request, the Petitioner, Fifth Third Bank filed a petition with the City of Aurora on March 27, 2015, requesting the Execution of a City Watermain Easement Agreement accepting the dedication of a City Watermain Easement at 1851 W. Galena Boulevard.  The requested easement agreement will allow the City to replaces an aging water main and provides additional redundancy by "looping" the dead-end to an existing dead-end fire hydrant on the Westminster Presbyterian Church's property.   
 
BACKGROUND:
The Subject Property is located at 1851 W. Galena Boulevard and is currently utilized as Fifth Third Bank with B-2 General Business District zoning.  The property is generally located at the southeast corner of Plum Street and Redwood Drive.  
 
DISCUSSION:
The Redwood water main from Illinois to Plum has had several breaks over the past few years, and the breaks are beginning to occur more frequently.  In addition, the service and fire hydrant serving the West Aurora Mall is on the City's dead-end watch list.  The dead-end watch list was created to keep a record of lines that are at risk of water quality and water pressure issues.  These dead-ended water main has no redundancy in case of failure.  This can jeopardize fire protection, and potable water quality and volume. The proposed project replaces this aging water main and provides additional redundancy by "looping" the dead-end to an existing dead-end fire hydrant on the Westminster Presbyterian Church's property.  This better serves both parcels and 5th/3rd Bank with improved fire protection.    
 
POLICIES AND GUIDELINES:
The Planning and Zoning Division would anticipate that this project will increase the City's overall tax base and viability by facilitating investment in the area.   
 
RECOMMENDATIONS:
Staff would recommend APPROVAL of the Resolution Authorizing the Execution of a City Watermain Easement Agreement accepting the dedication of a City Watermain Easement at 1851 W. Galena Boulevard

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
 
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
 
WHEREAS, Fifth Third Bank is the owner of 1851 W. Galena Boulevard and have agreed to grant the City of Aurora a City Watermain Easement at 1851 W. Galena Boulevard to replace an aging water main and provide additional redundancy in the area; and
 
WHEREAS, Fifth Third Bank is requesting the City of Aurora to enter into the City Watermain Easement Agreement attached hereto as Exhibit "A", with respects to granting said City Watermain Easement;  and   
 
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Aurora, Illinois, as follows:
 
Section One: The Preambles hereto are made a part hereof as fully as if completely repeated at length herein.
 
Section Two: That the Mayor and City Council hereby find that it is in the best interests of the City of Aurora and its residents that the aforesaid Easement Agreement with Fifth Third Bank be entered into by the City of Aurora, with said Agreement to be substantially in the form attached hereto and made a part hereof as EXHIBIT "A".
 
Section Three: That the Mayor and City Clerk are hereby authorized to execute for and on the behalf of the City of Aurora, the aforesaid Easement Agreement.
