SUBJECT:
A Resolution to approve Change Order #1 with Geneva Construction Co. in the amount of $401,785.00 for the Church Rd Water Tower Driveway work, post-bid Ward 4 work, and additional Citywide Resurfacing (West/North) project costs.
PURPOSE:
To approve Change Order #1 to the 2026 Citywide Resurfacing (West/North) Project.
BACKGROUND:
The driveway pavement at the Church Rd Water Tower is severely deteriorated and in need of significant repairs; it is most economical to construct those repairs under the Citywide Resurfacing contract. Additional work in Ward 4 utilizing Ward 4 funds was previously added to the contract as a small change and is being included in this Change Order due to the total change in contract value. As the Citywide Resurfacing (West/North) project has worked through most wards, several concrete items have expanded beyond what was originally contemplated in the plans.
DISCUSSION:
Geneva Construction Co. is currently under contract for the 2026 Citywide Resurfacing (West/North) Project. Bids for this project were opened and publicly read on April 16, 2026, and Geneva Construction Co. was determined to be the lowest responsible bidder. Construction on the project has been ongoing throughout the summer. The original contract value of the project was $4,648,733.10.
There is significant work needed to the driveway pavement at the Church Rd Water Tower. City staff recommend completing this repair work under the 2026 City Wide Resurfacing (West/North) contract which would allow for less expensive repair compared to bidding as a separate project due to benefitting from economies of scale and already mobilized work forces. A number of the pay items required are pay items in the 2026 resurfacing project, and Geneva Construction has provided reasonable agreed unit prices (AUPs) for the work not in the contract. This work is estimated to cost $110,000. The attached Exhibit 'A' is the location map and proposed scope of work limits, and Exhibit 'B' is an estimate of cost.
Some additional work has been added after contract award in Ward 4 utilizing Ward 4 funds. The work consisted of constructing new sidewalk and curb ramps near Monona Ave and Merrimac Pl (both of which were being resurfaced). This work has already been included on the Purchase Order and accounted for, however it is being included as part of this Change Order due to the overall magnitude of change to the total contract. This Ward 4 work is $23,000.
As work has been ongoing, efforts to fully repair deteriorated streets have proved more excessive than anticipated at the time of bidding. Concrete curb and sidewalk replacement quantities have been trending higher than expected in all of the wards on this contract. Some of the highest percent increases include the sidewalk in Ward 2, the curb in Ward 5, and the sidewalk in Ward 10. Some additional cost may be required to finish repairing the deteriorated streets in the program to City standards throughout the remaining wards. Staff is asking for additional funding to complete the project in case they are required. This work is estimated to cost $268,785, see Exhibit 'C'. The items in Exhibit 'C' represent a 5.8% increase in contract value.
For all pay items that were already in the contract, the unit costs shown in the change order are the same unit costs as the original contract.
Between the 3 items identified, the total increase to the contract would be $401,785.00. The new total contract value with Geneva Construction would be $5,050,518.10.
