Authorizing one additional carnival for the year 2024 at the Simon Premium Outlet Mall, notwithstanding the limitation set forth in the Special Events Ordinance.
PURPOSE:
To authorize the Director of Community Events to issue an additional special event permit in 2024 for a carnival at the Simon Premium Outlets.
BACKGROUND:
The Aurora Code of Ordinances, Chapter 41.5 was amended to limit the number of carnivals at any one location in the City to two per calendar year. In 2024, the Simon Premium Outlets successfully held two carnivals at its location. Simon has the opportunity to host one additional carnival, to be held over two weeks, before the end of the calendar year which is not allowed under Chapter 41.5, Section 41.5-156(h).
DISCUSSION:
Staff is asking for the authority to issue a permit for one additional carnival (for a total of three in the calendar year of 2024) at the outlet mall This request is limited to the year 2024 and would not amend the ordinance permanently. As proposed, this is a one-time, one-location exception to the two-carnival limit set forth in Sec. 41.5-156(h). Staff is presently evaluating whether to recommend a permanent change to Sec. 41.5-156(h) to allow for greater flexibility, but is not yet prepared to ask the Council to proceed in that manner.
IMPACT STATEMENT:
The positive impacts from allowing one additional carnival at the Simon Premium Outlet Mall is that this will provide additional entertainment for the shoppers of the mall and increase revenue at the mall. The impacts on first responders are minimal and the past two events hired Aurora Police Department Officers to staff the event to assist with any issues.
RECOMMENDATIONS:
Staff recommends that the City Council approves this ordinance to allow for one additional carnival at the Simon Premium Outlet Mall for the calendar year 2024.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS, Chapter 41.5, Section 156(h) allows any location in the City two carnivals per calendar year; and
WHEREAS, Simon Property Group (Simon), the operator of Chicago Premium Outlets has applied for and been issued two special event permits for carnivals upon its property in calendar year 2024; and
WHEREAS, said carnivals, as well as previous carnivals hosted by Simon upon the premises of Chicago Premium Outlets have been conducted safely and in accordance with the requirements of Chapter 41.5; and
WHEREAS, Simon has requested permission to host one additional carnival upon the premises of Chicago Premium Outlets in 2024; and
WHEREAS, the Director of Community Events has determined that the City has sufficient resources to accommodate the request, and that accommodating such request is in the best interest of the City; and
WHEREAS, the Director of Community Events has recommended that the City Council take whatever action is necessary to permit an additional carnival upon the premises of Chicago Premium Outlets in 2024;
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Aurora, Illinois, as follows: that the provisions of Chapter 41.5, Section 156(h) of the Code of Ordinances limiting the number of carnivals at any one location in the City notwithstanding, the Director of Community Events shall be and hereby is authorized to issue one additional special event permit for a carnival upon the premises of Chicago Premium Outlet Mall in 2024 for a maximum continuous duration of two weeks; and further
BE IT ORDAINED, that all other provisions of Chapter 41.5 are and shall remain in full force and effect and shall apply to any permit issued by the Director of Community Events authorized by this Ordinance; and further
BE IT ORDAINED, that to the extent that the provisions of this Ordinance conflict with the provisions of Chapter 41.5, the provisions of this Ordinance shall control; and further
BE IT ORDAINED, this that this Ordinance shall become effective upon its adoption, but shall have no force nor effect on or after January 1, 2025.
