A Resolution Approving a Revision to the Final Plan for West Aurora High School located at 1201 W. New York Street (West Aurora School District #129 / Whitt Law, LLC - 16-00587 / AU20/2-16.089-Rz/Su/Fpn/R - TV - Ward 4)
PURPOSE:
The Petitioner, Whitt Law, LLC, on behalf of the West Aurora School District #129, is requesting approval of a Final Plan Revision for West Aurora High School located at 1201 W. New York Street.
BACKGROUND:
The Subject Property is located at 1201 W. New York Street and is the home of the West Aurora High School with P(S) Park and Recreation, which is part of the West Aurora High School Special Use Planned Development. Additional information on the legislative history of the property can be found in the attached Property Information Sheet.
A Final Plan for the campus was approved in November of 2015. Since then, the School District has purchased additional land and is proposing to revise the Final Plan to include these properties and to relocate and modify some of the parking lots. The previously approved parking lot on the corner of Randall Road and Plum Street is being relocated to the west side of the existing Stadium. This parking lot will not be constructed until such time the geothermal is completed on the site. The parking lot at the northwest corner of Spruce Street and Fordham is shifting to the west slightly and the parking lot at the southwest corner of Spruce Street and Fordham is being incorporated into the adjacent parking lot. There will be a total of 830 parking spaces provided which exceed the total provided in the previously approved plan by 2 spaces.
Concurrently with this proposal, the Petitioner is also proposing Special Use Planned Development on four properties located along Randall Road, Spruce Street and Fordham Avenue, to be incorporated under the existing Special Use Planned Development for West Aurora High School, and to change the underlying zoning district from R-2 One Family Dwelling District to P Park and Recreation District.
DISCUSSION:
Staff has reviewed the Final Plan Revision petition and have sent comments back to the petitioner on those submittals. The petitioner has made the requested revisions to these documents and they now meet the applicable codes and ordinances.
POLICIES AND GUIDELINES / IMPACT STATEMENT:
The Staff’s Evaluation and Recommendation are based on the following Physical
Development Policies:
10.0 To provide for the orderly, balanced and efficient growth and redevelopment of the City through the positive integration of land use patterns, functions, and circulation systems. To protect and enhance those assets and values that establishes the desirable quality and general livability of the City. To promote the City’s position as a regional center.
11.0 To guide the growth of the City in an orderly and structured manner.
12.0 To plan and provide for the growth of the city through the integration of land use patterns and functions that promotes complementary interactions between different land use components.
RECOMMENDATIONS:
The Planning Commission recommends CONDITIONAL APPROVAL of the Resolution Approving a Revision to the Final Plan for West Aurora High School located at 1201 W. New York Street with the following condition:
1. That the Petitioner submit for approval a Final Plat to consolidate the property within 90 days from approval.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS, by petition dated June 16, 2016, Whitt Law, LLC filed with the City of Aurora a petition requesting approval of a Final Plan Revision for West Aurora High School located at 1201 W. New York Street and related required documents as attached hereto as Exhibits "A-1" through Exhibit “A-2”; and
WHEREAS, after referral of said petition from the Aurora City Council, the Aurora Planning Commission on July 6, 2016, reviewed the petition and recommended CONDITIONAL APPROVAL of said petition; and
WHEREAS, on July 14, 2016, the Planning and Development Committee of the Aurora City Council reviewed said Final Plan Revision and the before mentioned recommendations and recommended CONDITIONAL APPROVAL of said petition; and
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Aurora, Illinois, finds as facts all of the preamble recitals of this Resolution and hereby grants CONDITIONAL APPROVAL of said Final Plan Revision with the following conditions:
1. That the Petitioner submit for approval a Final Plat to consolidate the property within 90 days from approval.
BE IT FURTHER RESOLVED that the City Council of the City of Aurora hereby adopts the Special Use / Planned Development and related required documents, subject to Final Engineering approval, as attached hereto as Exhibit "A-1" Final Plan and Exhibit “A-2” Landscape Plan, along with any dedications or modifications deemed necessary by the Aurora City Engineer.
