Resolution authorizing the Emergency Management Coordinator to execute an agreement to transfer through donation the real property of one emergency outdoor warning siren located at Route 56 and Blackberry Creek to the Village of Sugar Grove, Illinois.
PURPOSE:
To obtain authorization for the Emergency Management Coordinator to execute the agreement that will transfer through donation the aforementioned emergency outdoor warning siren to the Village pursuant to the terms and conditions in the Intergovernmental Emergency Warning Siren Donation Agreement, which are attached as Exhibits A and B to this Resolution.
BACKGROUND:
Aurora and Sugar Grove entered into an Agreement for Activation of Emergency Warning Sirens in July 1999, and an Emergency Warning Siren Location Agreement in April 2001. Aurora and Sugar Grove previously entered into said agreements because the Village did not have the technology nor capability to test and activate the siren system. The two agreements outlined the location, maintenance, and activation of emergency warning sirens, and included a shared siren location within the boundaries of the Village or Sugar Grove. Under these agreements, Aurora maintained primary responsibility for the activation of sirens within Sugar Grove's jurisdiction through the Aurora 911 telecommunication center, while Sugar Grove maintained direct responsibility for maintenance of the system.
DISCUSSION:
Sugar Grove now has the capability to independently test and activate their emergency outdoor warning siren system. Aurora and Sugar Grove feel it is in the mutual best interest to terminate all existing agreements and to transfer to ownership through donation all future responsibility for maintenance and activation of the one remaining shared siren, located within Sugar Grove's municipal boundaries. Sugar Grove would like to incorporate the siren into its local siren system.
IMPACT STATEMENT:
The approval of the transfer through donation of the single emergency outdoor warning siren from Aurora to Sugar Grove will greatly improve efficiency and understanding by the public and decrease confusion by Aurora and Sugar Grove municipal representatives during severe weather incidents. The transfer of this single siren will have no impact on the public safety of Aurora residents as coverage of the Aurora Emergency Outdoor Warning Siren System is sufficient.
RECOMMENDATIONS:
It is recommended that the Emergency Management Coordinator be authorized to execute the donation agreement.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS, the Illinois Intergovernmental Cooperation Act, 5 ILCS 220/1 et seq. further authorizes intergovernmental cooperation; and
WHEREAS, Aurora and Sugar Grove are each "units of local government" as defined by Article VII, Section 1 of the Illinois Constitution of 1970 and are authorized to contract and agree with one another on matters of mutual concern; and
WHEREAS, Aurora and Sugar Grove entered into an Agreement for Activation of Emergency Warning Sirens, dated July 13, 1999, and an Emergency Waring Siren Location Agreement, dated April 6, 2001, regarding the location, maintenance, and activation of emergency warning sirens, including a shared siren located within the boundaries of the Village, as described and depicted in Exhibit A; and
WHEREAS, Under these siren agreements, Aurora maintained primary responsibility for the activation of certain sirens within the Village's jurisdiction through Aurora's 911 telecommunications center, while the Village retained responsibility for other aspects of the siren system, including its maintenance; and
WHEREAS, since the time of the Siren Agreements, Sugar Grove has developed the capability to independently activate and manage its own emergency warning siren system, which includes six outdoor emergency warning sirens within Sugar Grove, and has enhanced its system to better serve the needs of its community; and
WHEREAS, Aurora and Sugar Grove have each determined that it is in their mutual best interests to terminate the existing Siren Agreements and to transfer ownership and all future responsibility for maintenance and activation of the one remaining shared siren, located within Sugar Grove's boundaries, specifically located at Route 56 and Blackberry Creed, Sugar Grove, Illinois, to Sugar Grove, as described and depicted in Exhibit B; and
WHEREAS, Sugar Grove has expressed its intention to incorporate the siren into its local emergency waning system and utilize advanced technology, including integration with the National Weather Service, to improve the overall efficiency and responsiveness of its warning system for future emergencies; and
WHEREAS, Aurora and Sugar Grove wish to memorialize their agreement regarding the termination of the siren agreements and the transfer of ownership and all related responsibilities of the siren from Aurora to Sugar Grove, as described and depicted in Exhibit C and D; and
WHEREAS, pursuant to Aurora Code Chapter 14 Emergency Management Agency Sections 14-3 and 14-5, the desired donation of the emergency outdoor warning siren is in the best interest of Aurora and Sugar Grove municipalities and residents, respectively, as evaluated and determined by the Emergency Management Coordinator.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: The Emergency Management Coordinator is authorized to execute the Intergovernmental Emergency Warning Siren Donation Agreement with the Village of Sugar Grove pertaining to the real property located at Route 56 and Blackberry Creek in Sugar Grove, Illinois (Exhibit A). The Emergency Management Coordinator, through this Resolution, has the authority to assign all location rights to the underlying land to Sugar Grove as well as execute all necessary documents to make the assignment.
